Get up to speed: Congress mandated FMCSA to review current regulatory guidance every five years and ensure it is clear and consistently enforced. In response to FMCSA’s most recent request for input on regulatory guidance, ATA recommended modifying specific areas of the regulatory guidance for clarity, accuracy, and alignment with existing regulations or other guidance. ATA also emphasized FMCSA’s need to review and address its existing online Guidance Portal given its significant navigation challenges such as unclear search results, lack of organization, and the inability to locate relevant guidance documents efficiently. Bottom line: ATA recommended enhancing user-friendliness by improving search functionalities, adding a "regulatory citation" feature, and clearly distinguishing between current and archived guidance. Additionally, ATA urged FMCSA to implement a notification system for updates to guidance documents to ensure stakeholders are informed without constant manual monitoring. Information from ATA digest

How much do you trust the standard licensing markets to deliver? Do you require market participants to register standards, add on some essentiality checks, and offer a range of transparency-enhancing measures alike aggregate royalty and FRAND determination, but otherwise leave it to SEP holders and implementers to get on with it? Or, do you go for root canal treatment, and stimulate your grip on the creation of standards within the standard setting organizations (SDOs), before they even hit the standard licensing markets? Another way of looking at this: option (1), you reactively diminish the role of the SDOs believing they have failed to control the flooding of the standard licensing markets with half-baked SEPs from overseas. Or, option (2), you proactively empower (weaponize?) the SDOs to promote your geopolitical interest in stemming the flood by building a wall of your own. This week saw Europe taking another step towards option (1), as the European Parliament voted in favor of the SEPs Regulation on February 28 (see my previous posts), while the U.S., one day later, on February 29, put out a legislative proposal akin to option (2), with U.S. Senator Mark Warner and Marsha Blackburn introducing legislation aimed at restoring the U.S.’s position as a leader in international markets for emerging technologies.
