Insightful observation. My own experience of two webinars on arbitration by distinguished Prof.Chirag Balyan suggests that it is imperative to invite academicians at such conferences. The issue of not inviting academicians to arbitration conferences can be and should be seen as discrimination impacting diversity and richness of discussions. Moreover, the exclusion limits diversity of perspectives and ultimately, loss of the stake holders of such conferences. Thinking of taking Law LLB? Here’s my thoughts…. 1. If you are choosing law because of pressure from parents or others in your life and not because you think you’ll enjoy it - don’t do it. It’s not worth it. You will spend 3 years of your life doing something you hate, that’s miserable. It may feel hard to stand up to the pressure, but choose to do what you love. 2. Following on from the first point, if you are vacillating between law and another subject - close your eyes and visualise yourself studying each subject. What excites you? What inspires you? What interests you? What makes you feel happy? Go with your gut. People may say choose law over eg English literature because you’ll earn more money. Truth is, nothing is guaranteed in law. The big money jobs are highly competitive and if you don’t love it you’ll be miserable. 3. Remember, finding the career you love is a marathon not a sprint. You are at the very start of that journey. The great thing about law is you don’t have to study law at LLB level to become a lawyer. In fact people with other areas of interest and experience are often highly valued in the legal world. 4. Having said all that… go to some courts and tribunals, watch law in action, sign up to some chambers events email lists and go to some events, read legal developments - does all that excites you? Are you particularly passionate about a certain area of law? Do you enjoy debating and thinking deeply about law? Go for it, you will likely love it because you really do have to love the subject to enjoy a law LLB. 5. Are you choosing law because you are passionate about helping people, social justice and human rights? Fair warning, in most law schools you will be in a minority, surrounded by people who are doing it “for the money”. That can feel isolating. You will likely face pressure from various people to ditch your dream because it’s ’too hard’, ‘too stressful’ or because ‘you won’t survive’. However there are tonnes of us out there, people who have committed their lives to these areas of work and who are perfectly happy with that decision! Reach out beyond your university, do some volunteering, feel free to DM me for a chat if you find yourself in that position! Look out for the next Social Justice Law Fair (watch this space 👀) In summary - forget about all the noise surrounding you. Breathe. Visualise these 3 years ahead of you. What will make you happy? Go for it.

Title- Public Secrets of Law: Rape Trials in India. Author- Dr. Pratiksha Baxi Publisher Oxford University Press India Review by Aniruddha Mahadevan Sethi Dr. Pratiksha Baxi, a sociologist, feminist legal scholar and a current faculty at the Centre for Study of Law and Governance in JNU, presents a detailed ethnographic account of the rape trials conducted in the state of Gujarat particularly in the trial courts of Ahmedabad.  A public secret refers to those phenomena which are known to everyone but are difficult to articulate. Dr. Baxi through this study, reveals how the interplay of law and public secrets reduce rape trials in India to pornographic spectacles where the female victim’s body is viewed through a sexual gazed, making the rape trials a further traumatic experience compounding that of the crime itself. Through case-studies and erudite incisive analysis, the book discusses important themes such as indignities inflicted by spoken law, consent in medico-legal jurisprudence, position of minor victims in rape trials , compromise in rape trials and rape as an atrocity revealing various avatars of the phallocentric constructions of the law. (I.e. male-ness of the law)   Dr. Baxi differentiates between written law and spoken law and highlights the violence inflicted by the spoken law on the rape victims by making rape trials a humiliating experience. The process may not provide justice to the victims but definitely adds to their trauma. She laments the omission of considering this aspect in law reforms.  Dr. Baxi further highlights how Medico-legal literature and evidence in rape trials is used to dispense with the traumatic experience of rape but makes the female body speak of the crime. Such a scenario is then used to dispute the veracity of victim with an attempt to prove consent as against rape. This interplay of medical science and law reveals another harrowing dimension of the male-centric constructions of law governing rape trials.  Minor victims have a particularly despicable experience in rape trials. They first have to explain their trauma and body in adult terms but when they do so, their very child-ness is put on trial wherein their innocence is disputed, further adding to their trauma. The child is thus forced to be an adult but also remain a child at the same time.  Compromise in rape cases, though illegal, is not an unusual phenomenon in India. Dr. Baxi shows how factors such as social stigma, caste, family honour play a role in reaching a compromise between the victim and the perpetrators. Two types of cases are discussed i.e. where rape cases are compromised and secondly when consensual relationships are weaponised into criminal cases. All this is done to maintain the patriarchal hold over the female sexuality, disregarding the trauma inflicted on them.  . . Continued...

While the legal systems of the United States and India have distinct characteristics rooted in their respective histories, they also share several similarities: 1. **Common Law Tradition**: Both countries follow the common law tradition, which relies on judicial precedent and case law to interpret statutes and make legal decisions. This means that decisions made by higher courts serve as binding precedents for lower courts in similar cases. 2. **Constitutional Framework**: Both the United States and India have written constitutions that establish the framework for their legal systems. These constitutions outline the structure of government, delineate the powers and responsibilities of various branches, and enshrine fundamental rights and liberties. 3. **Federal Structure**: Both countries have a federal system of government, with powers divided between a central/federal government and individual states or provinces. This division of powers is enshrined in their respective constitutions and is essential for maintaining a balance between national unity and regional autonomy. 4. **Separation of Powers**: Both the United States and India adhere to the principle of separation of powers, which divides governmental authority among three branches: the executive, legislative, and judicial. INTERDISCIPLINARY RESEARCH AND INTERDISCIPLINARY LEGAL RESEARCHERS On the 22nd of May 2024, Max Planck Law hosted a two-day workshop on ‘Approaches to Legal Research’ at the Harnack Haus in Berlin. Several legal researchers across the Max Planck Institutes attended. After one of the sessions, the researchers pondered the identity crisis which often engulfs ‘interdisciplinary researchers.’ What is 'interdisciplinary research'? Can one even do ‘interdisciplinary research’? Can legal research be interdisciplinary anyway? The debate reminded me of two cases; the first was an insolvency dispute examining what a lawyer would term as complex accounts. Then we (the lawyers) were invited to take some accounting lessons to enable us cross-examine the experts efficiently and assist the Court in a fair determination of the issue of the solvency of a firm. The second is the famous 2017 Kenyan Presidential Election Petition in which the assessment of constitutionality of the election was partly premised on understanding the deployment and behaviour of a technology system. This necessitated IT expertise. These two cases for me pinpoint the growing relevance of interdisciplinary legal research and scholarship. Therefore, from the viewpoint of a practising lawyer also doing legal research, legal research can be interdisciplinary. Such research is relevant in contemporary legal studies and practice. On whether we can have ‘interdisciplinary legal researchers’, I think we can. In exceptional cases where a researcher has acquired qualifications in two different disciplines, they possess the capacity to do equity to two or more disciplines. The important question, however, is whether the interdisciplinary researcher can execute the task precisely. The risk being that their methodological approaches will be too broad and the study’s theme might in many ways become unappealing considering the frictions of theoretical integration. As noted by one of the attendees, such a researcher’s bias will often remain. If the researcher identifies themselves as a Lawyer or economist , they will be inspired by either identity in framing their research questions and later, in choosing which methods, sources and approaches they will use. I believe that the bias creates coherence and will often make one’s work more logical. In this context, the interdisciplinary researcher becomes a myth. Candidly therefore, one can avoid the identity crisis by being who they are. Lastly, interdisciplinary legal research is relevant. Be it Law and economics, Law and sociology, Law and anthropology or Law and technology. It gives insight into how different fields can complement and influence each other. I, for one, believes that if the study of legal history will grow in significance, a deliberate connection with other fields of law (contemporary fields) must be drawn. Well Well, I later took a fairly good picture along the staircase of the picturesque Harnack Haus. Tap tap, I returned to FFM.
