The Expanding Reach of Military Power on U.S. Soil: A Glimpse into DoD Directive 5240.01 When we think of military power in the U.S., it's often in the context of protecting us from foreign threats. But what happens when that power starts looking inward? The Posse Comitatus Act of 1878 was created to prevent the federal government from using the military for domestic law enforcement, a safeguard against blurring the lines between military and police—a critical element of maintaining our democracy. However, recently and quietly the Biden's Administration made some changes in the Department of Defense's directives that seem to challenge this principle: 🔫 Authorizing military action: Action is now permitted "when lives are in danger," provided it’s approved by an official. ☠ Lethal assistance: Permissible under DoDD 5210.56, the Department of Defense’s Use of Force Policy. 📡 Bonus: Intelligence agencies like the NSA can share information on U.S. citizens if they determine there’s a legal violation. The introduction of DoD Directive 5240.01 further broadens the military’s role, allowing them to assist in law enforcement during "civil disturbances." These developments warrant a closer look.
