People who come from government, whose costs are paid by the taxpayer, rarely appreciate the dynamics of commercial business and the sacrifices that founders and many others make to operate them. Criminals do understand, and take nefarious advantage of what their victims will pay to ensure business continuity. There are two ways of having a measurable impact on cybercrime. 1. Stop the money getting to cybercriminals. 2. Raise businesses resilience to cyberattack I do not think the UK Government takes cyber risk seriously because: To point 1. They have failed to regulate cryptocurrency effectively. A well regulated crypto sector would make significant inroads into preventing illegal use. That said, law enforcement agencies have worked (in the absence of effective regulation) to encourage exchanges to detect and prevent ransom payments. To point 2. They do not ensure effective enforcement of existing laws i.e. UK GDPR for negligence in cybersecurity as well as enacting and enforcing new, comprehensive specific cybersecurity law. Once the above suggestions are implemented we will see a big reduction in cyber extortion. If the above have not worked , we might then look at enacting laws which criminalise ransom payments. We must not forget that despite the scourge of Ransomware, 50% of cyberattacks also with huge losses to fraud are Business Email Compromise (BEC). Most of these would have been avoided if those involved (not always the principal victim) had not been negligent in cybersecurity. Properly enforcing the law and penalising negligent companies, hopefully before they are compromised, would also help to stem these losses. Whilst I like the support network suggestion in principle I fear it will not work well, and cost a lot to operate. This may force victims to break the law. It seems crazy to introduce a new law with complex enforcement when the government is not prepared to enforce existing laws to proactively force those who operate negligence and insecurity to become more resilient. Let’s use the tools already in the box properly before considering new ones.
This sounds like the correct decision, but who is going to tell the first few CISOs / victims that they can no longer pay the crims and that they need to fix the problem themselves?
