In our latest Case of the Week, CEO and Founder Kelly Twigger discusses the Court’s ruling on multiple issues in the parties proposed ESI protocol, in the latest decision in In re: Insulin Pricing Litigation, including another chapter in the saga of hyperlinked files and how existing technology impacts a party’s obligation to provide them in discovery. The court sided with defendants, finding that hyperlinked files are not the same as traditional attachments. From this story: "Some of the directors and other lawyers who are not tech-savvy do not usually activate the necessary privacy measures, they added." This is 100% my pet peeve. If your legal software requires lawyers to "activate" anything or, frankly, to do anything other than continue working the way they want/need to work, there's a problem. To be clear, I'm not at all saying that was the problem with either the firm or product discussed in this article. But friction between usability and privacy/security is a big issue in LegalTech. Lawyers shouldn't have to change how they work in order to be secure.
