STEERING INTO THE LEGISLATIVE SKID: FIXING THE NONDELEGATION DOCTRINE In our new second book, my co-author T.L. Smith and I address a critically important and timely issue: When does Congress shirk its representative duties by impermissibly passing off its Constitutional legislative responsibilities and accountability over to the executive branch? What is the judiciary’s proper role and review standard in assessing the rightful scope of Congressional delegation of authority to the executive branch to carry out related Congressional directives? This pressing issue has bedeviled the nondelegation doctrine for decades, and the Supreme Court’s current “intelligible principle” judicial review standard for excessive legislative delegation lacks any fixed and consistent iteration, practical application, teeth, or predictive value. We propose replacing the Supreme Court’s current ever-shifting “intelligible principle” standard with a new legal test, a fixed and clear principle that consistently and predictably distinguishes permissible from impermissible legislative delegations. As the Supreme Court is on the eve of deciding a number of potentially transformative cases on the thinking of proper Congressional delegation to the executive branch, we proffer a 4-part measuring stick to assess the propriety of legislative delegation based upon Justice Gursuch’s dissent in the Gundy v. U.S. case and through the lens of James Madison’s view of the republic.

In case you need a real example of an error of law, here is a clerical error in a statute
Though extremely rare, it is possible to find errors in statutes, such as this clerical error. There may also be drafting errors when the intention of Parliament and the meaning of the statute do not match. All errors can be resolved by the rules of statutory interpretation.

Republicans will soon find themselves in in control of the entire federal government—the White House, the Senate and the House of Representatives—for the first time since 2018.
