Maryland recently passed a new #paytransparency act that expands the current Equal Pay for Equal Work Law and goes into effect on October 1, 2024. The new Wage Range Transparency Act will require Maryland employers to include specific information on the wage range/salary, benefits, and any other compensation offered for a position in all job postings. According to the Act, the new requirements apply to: - All Maryland employers, regardless of their size; - Positions where the work is at least partially "physically performed" in the state of Maryland; - Both internal and public job postings; and - Postings made directly by companies or indirectly through a third party, such as a job site or a recruiting agency. Under the Act, employers are prohibited from discriminating against job seekers or employees who inquire about wage ranges, choose not to disclose their salary history, or exercise other legal rights. It also requires that wage ranges be determined "in good faith" by referring to one of the four metrics listed in the Act: 1) Any applicable pay scale; 2) Any previously determined minimum and maximum hourly rate or salary for the position; 3) The minimum and maximum hourly rate or salary of an individual in a comparable position at the time of the posting; or 4) The budgeted amount for the position. Employers covered under the Act should review their current covered job postings to ensure they comply with these requirements before the October 1st effective date. The U.S. Department of Labor (DOL) increased minimum salary for many exempt employees June 11, 2024 The U.S. Department of Labor (DOL) published the much-anticipated final rule that will increase the minimum salary for many exempt employees. The increase will take effect in two steps.
