Competition law in Africa is a growing field with varying levels of development across different countries. These laws are designed to promote market competition and prevent monopolistic practices that could harm consumers and hinder economic growth. AI and the 4th Industrial Revolution have seen the context grow more complex for regulators and there is now an increasing focus on digital markets and the need to address anti-competitive practices in the rapidly growing tech sector. Despite the promulgation of the ACFTA Competion Protocol, there is still very little capacity on the continent to handle this subject, leaving African businesses vulnerable to cartel behavior and non-compete practices. Several African countries have established competition laws and regulatory bodies, but their scope and enforcement can vary widely. For example, South Africa has a well-developed competition framework managed by the Competition Commission, while other countries like Nigeria and Kenya have also made significant strides in this area. Uganda just passed the Competition Act 2022 and is yet to establish the unite envisaged by the law. However with the dream of the ACFTA, we still find that the imbalanced progress in this area makes it hard for businesses to cross borders into countries that are not properly regulating competition. The African Union and regional economic communities like the East African Community (EAC) and the Economic Community of West African States (ECOWAS) are working to harmonize competition laws across member states to facilitate intra-African trade and investment. Without the states having qualified resources to partivipate in this improtant process, these efforts will be futile. Many African nations face challenges such as limited resources, lack of expertise, and political interference, which can impact the effective implementation and enforcement of competition regulation. We commend the COMESA Competition Commission for accrediting the Fidelis Leadership Institute to grow the capacity of regulators and raise awareness in East Africa on Competition regulation and consumer protection. Do take advantage of this opportunity to equip yourself for fresh areas of practice on the continent. While scale is valued at Gallagher, Michael tells Jonathan Swift why it will never be as important as consistent and sustainable growth: “Scale should not be just for vanity. It is only important if you do something with it: bring the best possible solutions to clients and make sure you get the best insurer deals in the market. We are really focused on growing the business year-on-year because that means a few things: it makes us investable, whether that is in people or tech platforms.
