They sign away any copyright claims to their work in exchange for a fee, contradicting international norms. In part 2 this week, I speak to the Screenwriters' Association (SWA) on their long-term ambition to make things fairer for their members. The big, hairy goal: to set up a copyright society that will track, calculate, and pay out royalties to all writers for their work. If successful, this will be the second such attempt after the IPRS began paying royalties to musicians after the 2012 amendment to the Copyright Act. Will it be successful though? A Kerala Court recently restrained the making of any films, graphic novels, merchandise, and spin-offs that feature the superhero from the Malayali film- ‘Minnal Murali’. -> The order came in the form of a temporary injunction as a result of the copyright suit filed by the writers of the film. -> The writers of the movie argued that since the copyright on screenplay and the copyright on cinematograph film are two distinct elements, the copyright of the screenplay vests with them as first authors. -> Weekend Blockbusters in partnership with Amar Chithra Katha and Spirit Media published a graphic novel ‘Minnal Murali Strikes Again’ retailing at ₹299 and being sold on various e-commerce platforms even though they did not have any copyright over the same. -> Additionally, it is also alleged by the writers that Weekend Blockbusters entered into deals for merchandising as well for which the royalties should have been paid to the writers. -> Considering the above grounds, the writers have sought a declaration that the copyright of the story and screenplay of the movie as well as the character Minnal Murali and other core characters vests with them. -> They have also prayed that a permanent prohibitory injunction restraining the creation or distribution of any rights related to their work be granted and for payment of royalties earned till now the graphic novel and merchandise. 📚📰📕 This week - for the 30th year in a row! - I gratefully received my annual share of Canadian 'Access Copyright' royalties - a compensation distributed to writers and other creators, whose work has been photocopied, used by various institutions, etc. (This is different from my actively seeking payment for use of my work - magazine/newspaper articles etc. - in specific situations, and selling first, second, third, one-time, rights, etc.) 📚 Creators like myself really appreciate this distribution of royalties. For me, it's not a huge amount (but nicely pays a bill or two, and buys a few treats), but what it represents is significant. Too, as a longtime self-employed writer, I've never had a salary, paid sick days, paid holidays, company pension or insurance, union representation, or any other benefits. 📚 I do, though, have the great satisfaction/ability of continually generating diverse work - as a ghostwriter, copywriter, journalist, publicist, fiction writer, tutor/guide, etc. And the yearly AC payment is a welcome little boost :) And each writing 'discipline' seems to enhance the others, and bring fresh energy and expertise to what I'm doing. 📚 BTW, I get a different payment every Feb. - the Public Lending Right compensation (from Canada Council for the Arts), to cover the use of my Celtic music/history book in libraries across Canada. #6 “A new version of my song is being made, how do we split master and publishing rights?” Understanding the Basics: - Master Rights: Refer to the ownership of the specific recording of a song. The owner controls the usage of that recording. - Publishing Rights: Pertain to the composition itself—melodies, lyrics, and arrangements—and are usually split between the songwriter(s) and publisher(s). When a new version of a song is created, the distribution of these rights needs to be revisited and potentially renegotiated to accommodate the contributions of all involved. Splitting Master Rights: The original holder of the master rights typically remains unchanged unless the new version involves significant contributions that warrant a reevaluation. For example: - If a producer remixes a song, they may negotiate a percentage of the master rights for the remix version. - In cases where a new recording is made, such as a cover, the artist performing the cover would own or share the master rights to that specific recording with the original artist or their label depending on the deal in place. Splitting Publishing Rights: Publishing rights can get a bit more complex, especially if new compositions or lyrics are added: - Original Composition Used: The original songwriters retain their publishing rights. Any new version that doesn’t alter the composition (like a straightforward cover) doesn’t affect these splits. - New Contributions: If the new version includes additional lyrics, melodies, or significant rearrangements, the contributors to these elements can claim a share of the publishing rights for the new version. This must be negotiated and clearly outlined in a written agreement. Best Practices: - Clear Agreements: Before proceeding with the creation of a new version, ensure all parties have a clear, written agreement on how both master and publishing rights will be split. The Fair Use Doctrine allows people to use #copyrighted #content for news, #education, commentary, or criticism. However, #copyright owners may assume that any use without #permission is a #violation. When working with other #artists, it's important to have a written contract that includes #details like payment #schedule and when payment will be received. When using images for marketing, it's best to use those that are #licensed for #commercial use or royalty-free. #Sharing someone else's #work without #crediting or getting permission is copyright infringement. This includes #images, #videos, or #PDFs. I’m still #savvy to new #legislation on digital #contract #laws being #introduced.
