Calling all facilities impacted by PFAS related regulations! EPA recently added seven PFAS to the list of chemicals that are subject to toxic chemical release reporting under the EPCRA and PPA, which will be effective June 17, 2024. This new guidance aims to provide more transparency and enhance environmental protection by excluding specific industries utilizing those chemicals from certain reporting exemptions and potentially available options for other TRI-listed chemicals. So happy to see the EPA has finalized and modernized amendments for new chemical review that will reform the process in a way that will allow it to better protect the health of our families. Chemicals, such as new PFAS, which can persist and bioaccumulate in our environment and our bodies, will now be "subject to a full robust safety review process prior to manufacture" and now also aligns with the requirements of the bipartisan Frank R. The US Environmental Protection Agency (EPA) has just taken its next step in the battle against "forever chemicals."💧 To better understand the human health impacts of PFAS, the EPA has issued its fifth test order under the Toxic Substances Control Act. This order targets 6:2 fluorotelomer acrylate, a PFAS compound used in manufacturing plastics, textiles, resins, and more. It's a strategic move in the EPA's broader PFAS Roadmap, filling critical data gaps on toxicity. On April 26, 2024, US Environmental Protection Agency (EPA) finalized its denial of the 2014 rulemaking petition by the Center for Biological Diversity (CBD) to list discarded polyvinyl chloride (PVC) as a hazardous waste under the Resource Conservation and Recovery Act.  PVC, a durable and widely used synthetic plastic polymer, presents potential environmental challenges throughout the product life cycle. CBD’s petition, initiated a decade ago, raised concerns regarding chemical leaching from PVC in waste, but largely focused on exposures during product use. CBD urged EPA to revise waste management guidelines to mitigate health and environmental risks from improperly disposed PVC. EPA found that the current evidence does not justify a change in its regulatory status, stating that the petition and public comments did not provide “sufficient information of a potential hazard to human health or the environment.” EPA highlighted the failure of the petitioner or public commenters to provide analysis of the potential for constituents or degradation products to migrate from discarded PVC into the environment under the specific conditions of a landfill or other waste management scenarios. Moreover, there was no attempt to estimate exposures to humans or quantify potential risks to human health or the environment.
