Types of bonds in construction: 𝟏. 𝐁𝐢𝐝 𝐁𝐨𝐧𝐝: A bid bond is a type of surety bond that guarantees the contractor's bid is genuine, and they will enter into the contract at the price bid and provide the required performance and payment bonds if awarded the contract. 𝟐. 𝐏𝐞𝐫𝐟𝐨𝐫𝐦𝐚𝐧𝐜𝐞 𝐁𝐨𝐧𝐝: A performance bond ensures the contractor will complete the project according to the terms of the contract. If the contractor fails to perform, the bond provides compensation to the project owner to hire another contractor to complete the work. 𝟑. 𝐏𝐚𝐲𝐦𝐞𝐧𝐭 𝐁𝐨𝐧𝐝: A payment bond guarantees that subcontractors, laborers, and suppliers will be paid for the work and materials they provide on the project. It protects these parties in case the contractor fails to make payment. 𝟒. 𝐌𝐚𝐢𝐧𝐭𝐞𝐧𝐚𝐧𝐜𝐞 𝐁𝐨𝐧𝐝: Also known as a warranty bond, this type of bond guarantees the quality of workmanship and materials for a specified period after project completion. If there are defects or issues during the maintenance period, the bond provides funds for repairs. 𝟓. 𝐒𝐮𝐛𝐝𝐢𝐯𝐢𝐬𝐢𝐨𝐧 𝐁𝐨𝐧𝐝: Subdivision bonds are required by municipalities to ensure that developers complete infrastructure improvements, such as roads, sidewalks, and utilities, within a subdivision. 𝟔. 𝐋𝐢𝐜𝐞𝐧𝐬𝐞 𝐨𝐫 𝐏𝐞𝐫𝐦𝐢𝐭 𝐁𝐨𝐧𝐝: Some jurisdictions require contractors to obtain a license or permit bond before they can legally operate. Unfair Sub-Contract term of the week to be wary of and to reject: 𝐏𝐇𝐘𝐒𝐈𝐂𝐀𝐋 𝐀𝐍𝐃 𝐄𝐗𝐈𝐒𝐓𝐈𝐍𝐆 𝐂𝐎𝐍𝐃𝐈𝐓𝐈𝐎𝐍𝐒 “The Sub-Contractor is also deemed to have fully acquainted himself with the existing structures, services thereto and all services installation therein and satisfied himself that they are suitable for the loads, stresses and other needs imposed and/or required by the Sub-Contract Works and, where not suitable, shall, subject to the prior written approval of the Contractor, make any alterations to or modifications to the existing structures and/or services as are necessary to make them suitable for such loads, stresses and needs. Any such alterations and modifications shall be deemed to form a part of the Sub-Contract Works, to have been allowed for in the Sub-Contract Sum and the Sub- Contractor shall not be entitled to any additional payments or to any extension of time for the completion of the Sub-Contract Works or such works in a Section (as the case may be).” ● The only reasonable and practical way for any Subcontractor to deal with this is to ensure that it is struck out in full. This clause is aimed at simply dumping unknown and unforeseen risk at the Subcontractor’s door. ● Responsibility for the suitability of existing structures should not be down to the Subcontractor – unless the package is specifically for such structural / repair works to the existing structure. ● A full structural appraisal and remedial works design would be required to enable any Subcontractor to make the pricing allowances which this clause requires. Which would also be an unreasonably onerous tendering cost burden, and make the Subcontractor’s bid uncompetitive against others who ignore such terms and make no allowances. ● The subcontractor is unlikely to be qualified to carry out structural alteration works in any event. #subcontractors #construction #paymentdispute #rjhconsulting #commercialawareness
