I'm perpetually grateful for the background in compliance I got whilst working at Sky before a move into product and then later marketing. When some businesses don't play by the rules, it might lead to short-term gains for the people playing fast-and-loose with consumer comms but over the longer term it erodes trust in the industry enormously, and forces other brands into unethical selling practices just to compete. There ARE many valid ways to use scarcity, social proof and authority in your selling strategy, but when you end up in the world of "I've called my manager and he's saying if you buy today, we can do this for 10% off" territory, you've vaporised all credibility. The same is true with a reference price that almost nobody ever comes close to paying. Hacks are for hacks. Have a product worth buying and a great way of talking about that product and the rest will flow.
We’re taking legal action against Emma, one of the UK’s best-selling mattress brands, after it failed to address all of our concerns relating to the use of reference pricing. This follows the launch of our investigation in November 2022, over concerns that some of its online sales practices, such as discounts and urgency claims may mislead consumers.
