Taking enforcement actions against participants and using those actions as a basis for future cases does not allow creators in the space to know if they are breaking any rules before the SEC files suit. With Digital Assets and Cryptocurrencies being a new technology it can be difficult to make existing laws apply to them. Now we know the SEC cannot make laws they can only enforce what is already in the books. We need congress to step in and create appropriate laws for the SEC to enforce while also allowing this new innovative space to blossom.

If you know me well, then you know I’m obsessed with Blockchain tech and how it will transform our world. I optimistically believe it will transform creative industries as well as many other spaces by giving credit and royalties back to original creators. I hadn’t considered how the Blockchain could transform our democratic systems by providing a more transparent process to put the people’s needs first.
