Have you found yourself in this common scenario? 😓 Fortunately, if your business hasn’t already been contacted or audited by a state regarding past due sales tax, you can request a voluntary disclosure agreement (VDA). 🗣 The VDA process generally works by contacting the state’s taxing authority (usually called the Department of Revenue) and disclosing that you realize you have been non-compliant. At this point, you don’t have to name your company and can remain anonymous. ➡ From there, the state will contact you regarding next steps. Often, this means abating much or all of the interest and penalties that your business owes. Note that the state may still request that you pay some portion of the taxes due. ✍ If you find that you owe past due sales tax in multiple states, you can also contact the Multistate Tax Commission and fill out a Multistate Voluntary Disclosure Application. ✅ Voluntarily disclosing is the best option to reduce your risk of audits and hefty penalties. Are you facing a problem on your input tax claims for a KRA imposed need for confirmation of accuracy of the transaction leading to the input tax claim? Some good news for you. The Tax Appeals Tribunal has recently held that there is no obligation on a taxpayer claiming input tax to procure from its suppliers confirmation of accuracy of the transaction forming the basis of the input tax claim. The Tribunal held that such a requirement is unknown to Section 17 of the VAT Act 2013. The Tribunal has further held that once a taxpayer has met the basic conditions set out under section 17 of the VAT Act, 2013, any condition imposed beyond section 17 of The VAT Act 2013 is unlawful. Although this decision does not solve the onerous requirement for a person to only claim input tax where the (sales) supplies leading to the input tax have been declared in a tax return by the suppliers, the decision asserts the position that section 17 of the VAT Act grants the KRA no discretionary powers to demand whatever nature of information they wish in the alleged quest of confirming the existence of a supply. While in most cases, such information requests are a mere attempt to defeat a taxpayer's input tax claim. #tax
