As an advocate for your client, there should always be a clear intent and purpose behind every statement you make and action you take. Are you serving you client’s best interests by taking the approach you have chosen? Have you explained to them why? Unfortunately, it is not uncommon to see futile polemics serving no purpose. The goal should always be a cost effective mutual resolution for all parties (where it is possible of course). Why adopt a litigious approach if it benefits no one? Aggression simply for the sake of being aggressive isn’t going to achieve anything more than an unjustified accrual of WIP and costs. This does not serve your client’s interests, it only serves your own—know the difference.
