Your expertise will help systematically align immigration routes to enhance economic strategy. 🔍 Project Aim: Conduct a systematic gap analysis of our client's immigration routes compared to the UK’s. Identify pragmatic actions for alignment and variations to support economic needs. 📊 Project Overview: Phase 1 – Review of Priority Routes: Analyse high usage immigration routes, including: Worker Migrant Routes (Health Visa, ICT, Seasonal) Family Routes (Appendix FM and Part 8) Tier 4 Student Routes Business Migrant Routes (Innovator & Start-up) Key questions to answer: Is alignment with the UK achievable? What are the benefits and risks of alignment/non-alignment? What roadblocks exist, and how can they be resolved? Detail options for action, including complete alignment and carve-outs. Phase 2 – Full Review of Routes: Expand analysis to cover all immigration routes upon successful completion of Phase 1, with potential for a third phase to create a detailed implementation plan. ⏱️ Timeframe: Project duration: 2-3 months. Open to well-justified alternative timelines. 📝 Method Statement: Provide a detailed method statement, including CVs of the team members involved. 📅 Department Retained Responsibilities: Establish a small project board. Organize checkpoint meetings. Provide administrative support for stakeholder conversations. 🔗 Additional Requirements: Regular and early consultation to address key issues. The Single Permit Directive recast has been formally adopted - what does this mean for EU companies and non-EU employees? 👇 🔔 What is it? The European Union adopted the Single Permit Directive in 2011 with the aim to create a single permit for both residence and work, establishing a single application process. This update builds upon the original Single Permit Directive of 2011, aimed at harmonising the process for residence and work permits across EU countries. It complements other Directives such as the Long-Term Residents Directive and the EU Blue Card Directive and it is applicable in all EU Member States except for Denmark and Ireland. 💢 What will be changing? 🔎 In-country Applications: Applicants residing in an EU country will be able to apply for a permit in-country. 🔈 This means: As long as their current permit is still valid, non-EU nationals won't have to go back to their countries to apply and they will not need the step of an entry visa, reducing the backlog at Consulates. 🔎 Faster Processing: The standard processing time has been reduced to three months. 🔈 This means: Whilst this is a welcome change, this does not take into consideration document gathering or appointment booking steps, thus it can be longer. 🔎 Flexibility in Employment: Permit holders gain the right to change employers after six months (sooner in exceptional circumstances), empowering them with more flexibility. 🔈 This means: Employers may need to adjust their negotiation strategies to keep their talent. In cases of laid offs or financial constraints, employees may be able to stay in the country. 🔎 Compliance and Further Rights: EU Member States are mandated to monitor employer compliance closely, with measures for individual redress in case of non-compliance. Also, permit holders can now remain in the host country for up to six months during temporary unemployment, ensuring stability. 🔈 This means: Further interconnection between Social Security, Tax, Labour Rights and Immigration regulations are expected. Monitoring that non-EU nationals have equivalent rights to nationals will be closely monitored. 💡 These changes are expected to increase the uptake of single permits, instead of national options. 📹 When will this happen? Member States have two years to implement the changes domestically.
