Recently, the Department of Communicaitions and Digital Technologies announced its intention to review the Postal Services Act, which refers to the Post Offices period of exclusivity. In other words, the Post Office has long held the exclusive right to be the sole provider of sub 1kg letters and parcel. Any and all private businesses would therefore in terms of the Postal Services Act be restricted from providing these services. However, this has not been the case, as you will know your likes of TakeAlot, PostNet et al continueto deliver parcels falling into these categories. Courier companies and similar businesses continue to encroach on the Post Offices exclusive right. Currently, there is ongoing litigation between your likes of Postnet, SA Express Parcel and Post Office to try and uphold the law and prevent these private companies from encroaching the Post Offices exclusive right. This application is supported by the Regulator, ICASA. However, as we know, this is still going to be a process.
