🔺 Our colleague Konstantin Voropaev has just published a new article “Ethical Dimensions of Patents: The Impact of the WIPO Treaty on Genetic Resources” at IPWatchdog, Inc*. The WIPO Treaty on Intellectual Property, Genetic Resources, and Associated Traditional Knowledge, was approved on May 24, 2024, and addresses the ethical use of genetic resources and traditional knowledge in patent applications. Key points about the Treaty include: 1️⃣ The WIPO Treaty aims to enhance the ethical framework of patents related to genetic resources and traditional knowledge, emphasizing transparency and fairness. 2️⃣ The treaty focuses on respecting and protecting the rights of indigenous communities, ensuring they receive fair compensation for their contributions. 3️⃣ Patent applications must disclose the origin of genetic resources and traditional knowledge, promoting transparency. 4️⃣ The treaty addresses biopiracy by ensuring that the use of genetic resources and traditional knowledge is properly credited and compensated. 5️⃣ Effective implementation faces challenges such as verifying the origin of resources and obtaining informed consent from diverse communities. ——— *IPWatchdog is an intellectual property publication, focusing on patents, innovation policy, trade secrets, copyrights and trademarks.

A recent agreement between ARIPO and the China National Intellectual Property Administration (CNIPA), which provides for a bilateral PPH program whereby an applicant can request accelerated examination of an application in ARIPO or CNIPA (based on a corresponding claim set that has been accepted by CNIPA or ARIPO) is an interesting development. It is worthwhile to note that the Harare Protocol already provides for expedited/accelerated examination of an application.

"Portable alpha is like synthetic Russian Roulette." Leading up to 2008, 25% of the top 50 North American institutions used portable alpha. After 2008, it was a forbidden phrase. But was it the strategy or the structure? (I'm biased, but I think a lot of it was the structure...) There's been a significant resurgence in interest in the concept this year. The Diplomatic Conference on Genetic Resources and Associated Traditional Knowledge ended on a historic note. Early today, WIPO member states adopted a groundbreaking new Treaty related to intellectual property (IP), genetic resources and associated traditional knowledge – marking a historic breakthrough that capped decades of negotiations: https://lnkd.in/eu2fz-jB. The Treaty, once it enters into force with 15 contracting parties, will establish in international law a new disclosure requirement for patent applicants whose inventions are based on genetic resources and/or associated traditional knowledge. As WIPO Director General Daren Tang stated, the approval of the Treaty by consensus is a strong signal that multilateralism is alive and well at WIPO. I’d like to congratulate all those involved in this successful endeavor and am looking forward to further collaborative work in shaping a strong, inclusive and resilient global IP ecosystem.
