What is your company's policy on drugs/alcohol use with respect to employees? Is it ZERO tolerance or some tolerance? Does the company actually ENFORCE its policy or is the policy there to "check off a box?" If you don't have an answer to these questions, you should. On one hand, things like medical marijuana (in many states), prescription drugs, and alcohol are technically legal, and it may not feel practicable (and potentially invasive) to govern what people can legally do on their own free time. On the other hand, marijuana, certain prescription drugs, and alcohol can cause impairment and lead to problems during working hours. An employee's use of legal substances off working hours can cause problems during working hours. So this is an issue for employers. Point being---as an employer, you should have a policy which carefully considers these issues and addresses the company's stances on drug/alcohol use, potentially drug and alcohol testing, whether the company offers assistance through EAPs or otherwise, and the consequences of violating the policy. What is the implication of an employee holding a medical marijuana card while in a safety-sensitive position? I get this question once a week and especially on NEO days. Here is what you need to know: Federal Compliance: Adherence to FMCSA and DOT regulations is mandatory, prohibiting marijuana use in safety-sensitive roles (Federal laws trump State laws). State vs. Federal Law: Prioritize federal regulations despite conflicting state laws. Policy Enforcement: If you have a robust drug & alcohol policy than you already ahead of the curve. If not Implement and enforce your drug and alcohol policies fairly and consistent. Safety Priority: Ensure safety-sensitive employees are not impaired by substances affecting performance. Risk Mitigation: Maintain compliance to mitigate legal and financial risks. Accommodation Assessment: Evaluate accommodation requests with safety and compliance in mind. The ADA does not require employers to accommodate illegal drug use, including marijuana. Employers should assess accommodation requests carefully, considering safety and legal compliance. Home Depot, one of the largest employers in the United States, is shifting its employee drug testing policies to remove cannabis from screening panels entirely and stop pre-employment drug testing of most of its workers. This also includes tests following a workplace accident and in cases where there’s reasonable suspicion an employee was impaired. This is actually huge. Workers compensation claims could be denied due to these screens and as we all know, just because you have traces of cannabis in your system, it DOES NOT mean you are currently impaired. I know that in this day and age of legalization of marijuana and increased prescription drug usage we are questioning the relevancy of our drug free safety programs. I think that our current state of affairs and drug use with the societal shift of acceptance indicates that drug testing for employment purposes is more important than it's ever been. Drug testing isn't about catching employees or punishing people, it's not even about the people who are using and abusing drugs and alcohol on the job, it's for everyone. It's to help everyone get back home to their families and when we overlook the impact of drug and alcohol use on our jobs many people don't get to come home. Remember you're not just testing for marijuana you're testing for a myriad of substances and the reason you're testing is to provide safe work environments. I'd like to see a commitment from companies and organizations nationwide to stand with me and not let our safety programs go up in smoke!
