New Delhi. The Election Commission has indicated that assembly elections will be held in Jammu and Kashmir soon. The Election Commission of India has invited applications from unrecognized parties registered in Jammu and Kashmir for the allocation of ‘election symbol’. This indicates that assembly elections are going to be held soon in the Union Territory for the first time after the abolition of Article 370. According to the statement of the Election Commission, they have decided to seek applications for the allocation of election symbol with ‘immediate effect’ under Para 10B of the Election Symbol (Reservation and Allotment) Order, 1968. While currently recognised national and state parties have their own ‘reserved election symbols’, registered unrecognised parties have to apply for them to field candidates in elections. Under the Election Symbols Order, any registered unrecognised political party can apply for an ‘election symbol’ six months before the term of the House ends. However, since there is no assembly functioning in Jammu and Kashmir yet, the Election Commission is calling for applications. At present, the date of the Jammu and Kashmir assembly elections has not been announced yet. However, in December last year, the Supreme Court had directed the Election Commission to conduct assembly elections in Jammu and Kashmir by 30 September. Although there were speculations about holding elections in the Union Territory along with the Lok Sabha elections, the Election Commission had said that this is not practical due to ‘security’ reasons. Sarvesh Singh became MP from Moradabad in UP by winning the Lok Sabha elections in 2014. Before this, he had been MLA 4 times from Thakurdwara assembly seat of UP. Will there be voting again? According to the rules of the Election Commission, if the voting process has been completed on a seat and after that the candidate dies, then the results of the election will be awaited. According to the rules, if any other candidate wins after the counting of votes, there will be no need for re-election. However, if Kunwar Sarvesh Singh wins the election then this election will be cancelled. There will be a need for re-voting or by-election on this seat. Because then he will not be present to represent his area. Under Section 151A of the Representation of the People Act, 1951, elections will have to be held on this seat within 6 months. What if he dies before voting? If a candidate dies before voting on a seat and if the date for nomination and withdrawal of nomination expires, then the election on the concerned seat is cancelled. For example, in the recently held Rajasthan Assembly elections 2023, Congress candidate Gurmeet Singh Kunnar from Karanpur seat of Sriganganagar had died. His nomination had been done. In such a situation, elections were held on this seat on a new date. New Post: Election Commission To Visit J&K For 3 Days Next Week To Prepare For Polls - https://lnkd.in/ghdEJcEs and Kashmir has been without an elected government for over six years.Srinagar: The Election Commission of India has confirmed that it will visit Jammu and Kashmir next week to review preparations for elections. The move is being seen as an indication that the Assembly elections in the Union Territory will be held before the deadline of September 30 set by the Supreme Court.The full commission, headed by Chief Election Commissioner Rajiv Kumar, will meet officials of the administration as well as representatives of political parties in Srinagar and Jammu during the visit, which will take place from August 8 to 10, it was announced on Friday. Sources said the commission is expected to announce the Assembly polls sometime after August 15 to meet the September 30 deadline. In December last year, while delivering its verdict on Article 370, a five-judge Constitutional bench of the Supreme Court had directed the poll body to hold Assembly elections in the Union Territory by September 30. It had also asked the Centre to restore statehood at the earliest.On Wednesday, the Commission had asked the Jammu and Kashmir administration to transfer officials posted in their home districts as well as those connected with the election process who will be completing a three-year tenure on or before September 30.Similar directions had been given to the chief secretaries of Haryana, Maharashtra and Jharkhand, where elections are due later this year.Jammu and Kashmir has been without an elected government for over six years and the last Assembly elections were held in December 2014.Next week, Jammu and Kashmir will also complete five years as a Union Territory. On August 5, 2019, the erstwhile state was bifurcated into two Union Territories and its special status under Article 370 was removed. Since then, Jammu and Kashmir has been administered by the lieutenant governor.The Centre has also recently amended the Jammu and Kashmir Reorganisation Act, 2019, giving sweeping powers to the lieutenant governor in the Union Territory. The amendments are in line with the Delhi Union Territory model, where the elected government has little authority over bureaucracy and many powers are vested in the Lieutenant Governor.Opposition parties have reacted strongly to the Centre's move and termed it "anti-democratic". They allege that giving sweeping powers to the LG will make the elected government a rubber stamp.During his visit to Srinagar in June, Prime Minister Narendra Modi had announced that Assembly elections would be held in Jammu and Kashmir soon, and statehood would also be restored.source

LG Elections: Enugu gov’t orders restriction of movement across the state, tomorrow from 6 am to 4 pm Ahead of the local government elections scheduled for tomorrow, Saturday, September 21, 2024, the Enugu State Government has announced a restriction of vehicular movement in the state from 6am to 4pm to ensure an orderly and hitch-free exercise, stating that the earlier announced time-frame of the restriction of movement had been reviewed and reduced. The State Commissioner of Police, CP Kanayo Uzuegbo, had earlier in the day released a statement ordering a restriction of movement from 12 am to 6 pm on Saturday, September 21, 2024 for the election. However, the government, in a public service announcement signed by the Secretary to the State Government, Professor Chidiebere Onyia, said the restriction of movement would now be from 6am to 4pm, following a further review by both the government and the State Police Command. The government said the restriction would enable the Enugu State Independent Electoral Commission, (ENSIEC) to conduct councilorship and chairmanship elections in the 260 wards and 17 local government areas of the state. “To ensure orderly and hitch-free elections, the Enugu State Government has ordered a restriction of movement in the 17 local government areas of the state. “There shall be no vehicular movement on the roads and or any form of transportation in the state from 6am to 4pm on Saturday, September 21, 2024, except persons on election or essential services such as ENSIEC officials, accredited election observers, authorised media practitioners, as well as health workers, ambulances and firefighters on emergency duties.” “While the temporary inconveniences are regretted, government enjoins Ndi Enugu to adhere to the directive for the free, fair, credible, orderly, secure, and peaceful conduct of the elections. “Security agencies have been briefed and are to ensure the enforcement of the order. All security agents not formally posted to election duties by their respective agencies are barred from the vicinity of the election venues”, the statement reads. Rahul Gandhi missing from election campaign At the same time, if we look at the way of campaigning of the biggest opposition leader Rahul Gandhi, the ‘Bharat Jodo Nyay Yatra’ started by him ended on March 17 after the announcement of elections. Since then, till May 8, Rahul Gandhi has addressed 39 public meetings, which includes 1 in March, 29 in April and 10 in May. Along with this, there are many places in these public meetings where the chances of Congress winning are very less or nil. However, the figures of these public meetings of Rahul may be higher. Uttar Pradesh Lok Sabha Election Result 2024 Analysis: The biggest upset happened in Uttar Pradesh in the Lok Sabha elections 2024. This time BJP’s seats decreased by almost half as compared to the last election. While Samajwadi Party (SP) reached 37 seats directly from 5 seats. Mayawati’s Bahujan Samaj Party (BSP) was dealt a blow. BSP did not get a single seat. Who got how many seats in UPOut of 80 Lok Sabha seats in Uttar Pradesh (UP Election Result), 37 seats went to Samajwadi Party (SP). Bharatiya Janata Party (BJP) won 33 seats. Similarly, 6 seats went to Congress. 2 seats went to Rashtriya Lok Dal (RLD), one seat went to Chandrashekhar Azad’s party Azad Samaj Party (Kanshi Ram) and one seat went to Apna Dal (Sonelal). Why is BSP the biggest loser?BSP emerged as the biggest loser in Uttar Pradesh. Mayawati’s party did not get a single seat. It did not even come second on any seat. Whereas in the 2019 Lok Sabha elections, it had won 10 seats. It was the second largest party in the state after BJP. Another thing to note is that in the 2019 elections, BSP had got 19.43% vote share. This time its vote share came down to 9.43%. That is, there was a loss of 10.04%. On the other hand, BJP’s vote share also decreased to 41.37% as compared to 49.98% in 2019. That is, it also lost 8.61% vote share. Did not even get 1% votes in the countryNot just Uttar Pradesh, Mayawati’s party proved to be a loser across the country. This time, it fielded candidates on a total of 485 seats. Subject: General Elections to House of People (Lok Sabha), 2024- Temafer/Posting of Officers- regarding Sir I am directed to refer to the subject cited above and to say that as per Commission's letter No. 437/6/1/INST/ECI/FUNCT/MCC/2023 dated 21/12/2023, it was conveyed that no officer connected directly with elections shall be allowed to continue in the present district (revenue district) of posting:- (6) If she he is posted in her/his home district. If she he has completed three years in that district during last four years or would be completing 3 years on or before 30 June, 2024, (iii) While calculating the period of three years, promotion to a post within the district is to be counted. 2 Under Para 5(ii) of this letter, it has been clarified that these instructions shall also cover the Officer deputed in Municipal Corporations ie Municipal Commissioners/Additional and Deputy Commissioners are also covered under the transfer/posting policy. 3. The Government of Maharashtra did not comply with the order and instead vide its letter No. AEO-1023/C.R.523/2023/X dated 15/01/2024 sought clarification if these instructions are also applicable to the Divisional Commissioners, Municipal Commissioners, Additional Commissioners, Chief Executive Officer of Zila Parishads etc 4 The ECI vide letter letier No. 437/6/1/INST/ECI/FUNCT/MCC/2023 dated 22/12/2024 clarified that Municipal Commissioners and Additional Municipal Commissioner are covered under para 5.2 of ECI instruction dated 21/12/2023. It was also clarified that Divisional Commissioners and Chief Executive Officers of Zila Parishad are also covered under Comission transfer/posting instruction in case they are supervisory Officers in the direct chain of command of the election related officers/employees. However, till late State Government of Maharashers has not transferred some of the Municipal Commissioners and Additional Municipal Commisioners/ Depoty Municipal Commissioners who are covered under Commission's transfer/pesting policy Now, therefore, the Commission conveys displeasure to the Chief Secretary, Government of Maharashtra and directs him to immediately: (1) Transfer Shri Iqbal Chahal, Commissioner of BMC from his present post of Commissioner of BMC Mumbai (1) To transfer all the Municipal Commissioners Additional Municipal Commissioners Deputy Municipal Commissioners who have served more than 3 years in the present posting and are posted in their home district in the state of Maharashtra The Compliance Report in the matter he conveyed to the Commission latest by 05:00 PM, tomorrow Le. 19/03/2024. One Nation, One Election The High-Level Committee on One Nation, One Election, led by former President Ram Nath Kovind, has proposed significant changes to enable synchronized elections across India. One Nation One Election (ONOE) One Nation One Election is a proposal to synchronize the timing of all elections in India, including those for the Lok Sabha, state legislative assemblies, and local bodies. The aim is to streamline the electoral process, reduce campaign expenditures, minimize disruptions to governance, and enhance political stability by holding all elections simultaneously at regular intervals, typically once every five years. ONOE was the norm until 1967 but after that cycle was broken. Earlier Law Commission also recommended the idea of ONOE in its report. Recommendations of the High-Level Committee: Two-step approach for Simultaneous Elections (SE): Synchronize Lok Sabha and State Legislative Assemblies (SLA) elections first, followed by Municipalities and Panchayats elections (M&PE). Amendments in Article 324A are required for this synchronization, but states’ ratification is not necessary. The amendments needed for simultaneous elections are outside the scope of Article 368(2) and thus don’t require ratification by the states. Municipal and Panchayat elections should be held within 100 days of Lok Sabha and State elections. Dealing with hung House, adoption of no-confidence motion, and defection: For Lok Sabha, fresh elections should be held with tenure limited to the unexpired term of the previous Lok Sabha. For States, fresh elections should be held, continuing until the end of the full term of Lok Sabha. Amendments in Article 83 and Article 172 are needed, but state ratification is not required. Single electoral roll and electoral identity cards: An amendment to Article 325 is recommended, which will require states’ ratification. Presidential Notification: A Presidential notification would set an “appointed date” for simultaneous elections. Constitutional Authority of Parliament for ONOE: The Constitution mainly entrusts Parliament, not states, with the power to conduct Assembly elections. Under Article 328 of the Constitution States have only residual powers on conducting Assembly elections; the power is mainly entrusted to Parliament through Article 327.
