Is catfishing a violation of GDPR and the Data Protection Act 2018? At first glance, it would appear so. Catfishing involves the misuse of photos with people’s faces and other personal data in order to pretend to be other people. This is clearly a violation, but... who are the victims? It is usually clear that the person whose images have been stolen are the real victims. But often, those who feel the harshest impact from the misuse of data are those who are catfished. Are they not also victims of this type of breach of data? Currently, there is no clear answer regarding the liability of the violator to the catfished victim. This new documentary sheds some light on how the law already fails to address this type of behaviour from a criminal standpoint.
