While Finland's companies have stepped up collaborations with UNDP, UNICEF, and UNOPS - with Business Finland's focused support - there remains a broader narrative on our approach to international procurement. The Finnish commitment to excellence is commendable, yet it brings to light a recurring challenge: meeting the UN's cost-conscious mandates. Beyond this, the Finnish impact is sometimes understated due to innovative collaborations with foreign companies, which, while productive, don't get captured in Finland's procurement statistics. The ground reality suggests a deeper engagement and contribution than what is immediately apparent. For Finnish innovations to truly thrive in this dynamic marketplace, forging ahead isn't enough. We need strategic partnerships that provide continuous market intelligence throughout our development process. The goal is not just to innovate but to innovate with market demand and pricing structures in perspective. Too often, by the time a Finnish innovation is ready for pilot testing, the market has shifted, or the product is priced out of contention. R&D is seen as our forte, and it does shape the perception of Finnish innovation. On 20 July 2024, Republic Act No. 12009 or the New Government Procurement Act (NGPA) was signed into law by the president of the Philippines. Significantly, the NGPA, among others, aims to promote efficiency by implementing an organized, uniform, and straightforward government procurement process through the use of emerging technologies and innovative solutions. The NGPA further provides that the implementing rules and regulations of the NGPA (NGPA IRR) shall be formulated by the Government Procurement Policy Board (GPPB) within 180 days from the promulgation of the NGPA. Moreover, within 90 days from the approval of the NGPA IRR, the standard forms for procurement shall also be formulated and approved. 📢 New CJUE Decision Clarifies Rules for Third-Country Economic Operators in EU Public Procurement 🏛️ On October 22, 2024, the Court of Justice of the European Union (CJEU) delivered a landmark ruling in Case C-652/22, providing much-needed clarity on the legal framework governing the participation of third-country economic operators in public procurement procedures within the EU. 🔑 Key Takeaways from the Judgment: 1️⃣ Third-country operators only benefit from equal treatment if their countries have signed international agreements with the EU ensuring reciprocal access to public procurement markets. 2️⃣ Although EU law does not explicitly prohibit the participation of third-country operators, they cannot invoke EU Directives to claim equal treatment unless their country has a specific agreement with the EU. 3️⃣ The ruling reinforces the EU’s exclusive competence over regulating third-country access to public procurement markets, a critical aspect of the Union's common commercial policy.
