In the coming weeks and months I will be sharing draft papers that formed the basis of my recent book 📕 Digital Currencies and Public Law: History Constitutionalism and the Revolutionary Nature of Money (2024, Routledge) This collection of papers is entitled the ‘Money, History and Digital Finance’ series. In this paper (01/2023) I argue that the nature of money and the nature of government are intimately interconnected; alterations in one invariably reverberate through the other. A law professor from the East China University of Political Science and Law has underscored the pressing necessity for China to establish standardized procedures for the recovery of illicit digital assets, in light of the increasing prevalence of cryptocurrency-related crimes. He pointed out that the absence of consistent standards complicates the asset recovery process and called for the development of comprehensive guidelines alongside international collaboration to effectively manage digital currencies. Several years ago, I completed an assignment for a futures thinking course that involved using a combination of signals from news stories to create a future scenario. A signal is something concrete and present that might become more common and widespread in the future. At the time, in 2019, the signals I chose were: China starting work on a digital currency, video faking algorithms and tensions between China and the West. The scenario I created seemed like something out of a Science Fiction film. How plausible do you think it is today? Let me know your thoughts in the comments. It’s the year 2030 cash has been largely replaced by digital currencies, with the U.S. dollar maintaining its dominance. In a startling turn of events, the U.S. President announces on national television that the digital USD has been compromised. The public are unaware that this announcement is the result of sophisticated video faking algorithms, casting doubt where none exists. Panic spreads, hackers seize control of media outlets, amplifying the hoax across social networks. The digital infrastructure, designed to phase out physical currency, leaves people scrambling for the dwindling reserves of cash. Amidst the chaos, confidence in the dollar plummets, triggering a run on the currency that underpins global finance. China, having pioneered the shift to digital currency, positions the Renminbi as the stable alternative. Leveraging its technological infrastructure, it offers seamless access to the digital RMB, drawing global consumers into its orbit. Transactions in RMB surge, as individuals and businesses seek stability. This sudden pivot to the RMB, facilitated through Chinese digital wallets, grants China access to personal user data and international transaction data on a scale not seen before, shifting the geopolitical landscape.
