Several states have passed pay transparency laws, which require employers to publish salary ranges for job openings. Generally, employers who operate or hire within these jurisdictions are required to include salary range data in the job posting. The pay range should reflect fluctuations in salary based on the person’s qualifications and experience but must have both a bottom end and a cap. Even if your organization doesn’t operate within a jurisdiction that requires pay transparency, your human resources department needs to stay apprised of this trend. Attention Employers in Washington, D.C.! Important update: Starting June 2024, new rules are in place regarding salary transparency. Mayor Muriel Bowser signed the Wage Transparency Omnibus Amendment Act of 2023 (Bill 25-194) on January 12, 2023. Employers with at least one employee in D.C. must now provide salary ranges in all job listings, showing the minimum to maximum projected salary or hourly pay. Additionally, healthcare benefits must be disclosed to applicants before the first interview. Remember, it's now illegal to base hiring decisions on an applicant's wage history or ask for salary history during interviews. New pay transparency regulations are set to take effect on January 1, 2025! Employers with a workforce of 15 or more will be required to openly share salary ranges and benefits in their job advertisements. Additionally, they must keep detailed records of job postings, pay scales, and wages for each role for a period of five years. This initiative aims to promote equity and fairness in the workplace by ensuring potential employees are fully informed.
