A new EU law on health data is coming: here’s what you need to know. Adopted in April but still undergoing a jurist-linguistic check, the European Health Data Space #EHDS will enter into force in autumn, likely unconcerned by the ongoing political drama in Paris and Brussels. To make sure our hundreds of members in the #healthtech, #medtech and #wellness sectors are prepared, we have drafted a concise guide (or 𝘥é𝘤𝘳𝘺𝘱𝘵𝘢𝘨𝘦, as we say in French) to this new Regulation. On June 6, 2024, the federal Minister of Health introduced Bill C-72, which is described as the Connected Care for Canadians Act ("CCCA"), and seeks to enable secure access to one's own health data. Working across federal and provincial governments, Bill C-72 aims to accelerate adoption of common interoperability and data standards to enable secure information sharing across platforms. Bill C-72 is aimed at "health information technology vendors" and the provision of "health information technology," which includes "hardware, software, integrated technologies, intellectual property and upgrades that are designed for creating, maintaining, accessing, using or exchanging electronic health information or that support such activities." The Bill provides that health information technology is interoperable if it "allows the user to easily, completely and securely access and use all electronic health information and exchange all electronic health information with other health information technologies, unless any applicable federal, provincial or territorial law on the protection of personal health information prohibits that access, use and exchange." It also prohibits data blocking. The impact of Bill C-72 is likely to be broad, impacting all providers of health care and health technologies. How is the EU performing in enabling citizens' access to eHealth data?   Last week, with the Digital Decade Report, we discovered how digital is the EU and the progress towards a successful Digital Decade by 2030. But what about the eHealth data in Europe?   The Digital Decade target for eHealth is that 100% of EU citizens can access their electronic health records online by 2030. In 2024, the EU scored 79% in the Digital Decade target of all EU citizens with electronic health records online access.   This is what the eHealth indicator report investigates:   🔵 More categories of healthcare providers are connected to the access services, but private healthcare providers are less connected than public ones. 🔵 A diverse selection of health data is available to citizens, but certain data types such as medical images and medical devices have limited availability in the EU-27. 🔵 Digital platforms to access electronic health records are widely available, but not all online access services enable the highest standards of authentication using eIDs. 🔵 Adherence to web accessibility requirements improved substantially in the past year, but opportunities remain to improve access opportunities under existing legal provisions.   What can you expect when accessing your health data online in 2024 as an EU citizen?   🔵 The most mature data types include data about Identification (94%), Personal information (85%), and ePrescription (81%). The least mature data type is medical images (26%). 🔵 Online portals are the most prevalent access mode to health data, and 13 Member States offer both online portals and native mobile applications. 🔵 17 EU countries enable citizens to authenticate themselves using eIDs (pre-)notified eIDs under the eIDAS Regulation. 🇪🇺 Interesting facts about the European Health Data Space (EHDS): 🤝 This agreement is designed to facilitate the exchange and access of health data across EU member states. 🗳️ The MEP supported by a strong vote in the European Parliament - voted with 445 in favour and 142 against (39 abstentions) -, aims to empower patients by enabling them to access their electronic health records (EHR) from any EU country and allow health professionals to consult patient records with consent. 🗂️ The EHR will include essential medical information such as patient summaries, electronic prescriptions, medical imaging, and lab test results. 💻 The EHDS framework is built on the MyHealth@EU infrastructure which will ensure the secure transfer of health data across the EU, especially useful for individuals relocating within the Union.
