I incorporated my company in early 2023 and got an O-1A visa to work through it as a founder. If you’re just starting, here’s what you can do to get your O-1A as a founder. Context: I incorporated a company as soon as I landed in India in early 2023. After building it for 9 months in India, I obtained an O-1A extraordinary visa as a founder & CEO through my company to enter America. If you want to build a company and get your O-1A as a founder, here are some starting points: ✅ First: you CAN incorporate a company without a visa Yes, you can. The great thing about America being a capitalist hub is that incorporating a company only takes 15 minutes and <$500. You don’t need a work visa to do it. You can even do it from outside the country. But, you do need a valid work visa obtained through the company to do active work for it. ✅ Second: why the O-1A is a great visa for founders First, here’s why you should consider the O-1A. - You don’t need to go through a lottery system. - There is no annual cap on the number of visas. - You don’t need to make a minimum wage. - You can renew it forever after the first 3 years. - You CAN file it as a solo founder. ✅ Third: Meet 3/8 criteria to quality for O-1A While the O-1A has great benefits, it’s not for everyone. It’s meant for people at the top of their fields, who have consistently contributed to it. You need to show this by meeting the 3/8 criteria set by USCIS. In my view, this rule could profoundly disrupt the journey of international students. Here’s why: 👇 1️⃣ 𝐅𝐢𝐧𝐚𝐧𝐜𝐢𝐚𝐥 𝐒𝐭𝐚𝐛𝐢𝐥𝐢𝐭𝐲 𝐌𝐚𝐭𝐭𝐞𝐫𝐬 💸 For international students, a full-time working dependant offers crucial financial support, allowing focus on studies and career goals. Removing this option increases financial strain, pushing students toward unrelated work just to get by. 2️⃣ 𝐌𝐞𝐧𝐭𝐚𝐥 𝐚𝐧𝐝 𝐄𝐦𝐨𝐭𝐢𝐨𝐧𝐚𝐥 𝐒𝐮𝐩𝐩𝐨𝐫𝐭 𝐈𝐬 𝐂𝐫𝐢𝐭𝐢𝐜𝐚𝐥 ❤️ A dependant brings the comfort of “home” abroad. Without this support, students face the challenges of a new environment alone, risking mental health, academic performance, and their potential to excel. Family is a lifeline—not a luxury. 3️⃣ 𝐃𝐞𝐜𝐫𝐞𝐚𝐬𝐢𝐧𝐠 𝐑𝐞𝐭𝐮𝐫𝐧 𝐨𝐧 𝐈𝐧𝐯𝐞𝐬𝐭𝐦𝐞𝐧𝐭 📉 With today’s high living costs, relying on part-time income alone is challenging. Many students take out loans, counting on a strong ROI; this rule jeopardizes that, potentially leaving students financially vulnerable. 4️⃣ 𝐒𝐭𝐫𝐚𝐢𝐧𝐞𝐝 𝐑𝐞𝐥𝐚𝐭𝐢𝐨𝐧𝐬𝐡𝐢𝐩𝐬 💔 Forced separation from loved ones takes a toll, impacting students’ ability to stay focused and fully invest in their studies. 𝐀 𝐅𝐢𝐧𝐚𝐥 𝐏𝐥𝐞𝐚 𝐭𝐨 𝐭𝐡𝐞 𝐔𝐊 𝐆𝐨𝐯𝐞𝐫𝐧𝐦𝐞𝐧𝐭 🙏 My wife and I had an incredible, life-changing experience in the UK that shaped our careers and lives: ✅I earned two valuable master’s degrees ✅I managed three internships and a full-time role at the University of Dundee ✅My wife worked with HSBC UK ✅Together, we quintupled our initial investment within four years I urge the government to reconsider this policy, as it may deter future international students. It was Mother's Day, so naturally I was feeling emotional. To avoid being overly emotional or sentimental, here are the facts: 🇺🇲Your children can legally enroll in school. 🇺🇲Your spouse can legally work or attend school. Now here's the most important piece: you must be able to show strong ties to your home country. **Examples of strong ties:** - Homeownership or a mortgage - A legitimate and established business - Current or future employment. The approval rate for J2 visas varies by country and is not publicly disclosed. However, here are some general factors to consider *Eligibility Requirements:* - Be the spouse or unmarried child (under 21) of a J1 visa holder - Be allowed to accompany the J1 visa holder by their sponsor or program *Application Process:* - Similar to J1 visa application - Requires separate DS-2019 form - Pay $185 application fee - Schedule an interview and provide required documents *Approval Chances:* - Depends on meeting eligibility requirements - Completeness and accuracy of application - Interview performance - Program sponsor's approval *Processing Time:* - Varies by case, but typically around 30 to 90 days *Validity:* - Tied to the validity of the J1 visa - Can apply for extension if J1 visa holder applies *Employment Authorization:* - J2 visa holders can seek employment with an EAD - Must apply after arriving in the US - Requires Form I-765 and supporting documents Keep in mind that the approval process and requirements may vary depending on individual circumstances and the specific J1 program sponsor. #j1visa ##bridgeusa #j1trainee #j1internship #j1intern

As someone who has experienced the challenges and opportunities that come with being an international student, I've often thought about why many in our community lean toward seeking employment rather than launching their own ventures. Here are some insights: 1.Visa and Work Authorization: For most international students, navigating complex visa regulations can make starting a business a daunting task. Often, work visas limit options, pushing students to seek stability through traditional employment. 2.Financial Barriers: Launching a business requires capital, and without access to local loans or substantial funding, international students may not have the financial foundation needed to kickstart an entrepreneurial journey. 3.Risk and Stability: Entering the workforce provides a level of financial security that entrepreneurship does not. With loans to repay and families to support, many choose the stability of a paycheck before venturing into the uncertain world of startups. 4.Building Networks and Understanding Local Markets: It takes time to build strong professional networks and understand local business dynamics.
