These new rules aim to restrict hemp products sold in smoke shops, gas stations, and more by limiting THC content, reducing servings per package, and requiring buyers to be 21+. The move has sparked a lot of discussion in the cannabis and hemp industries. This legislation would mean significant changes to the national cannabinoid hemp industry, including adding a chapter to the federal Food, Drug, and Cosmetics Act that would govern cannabinoid hemp. Such a move ultimately means general FDA regulation of cannabinoid hemp products. By contrast, in New York the OCM is under the Liquor Authority post-legalization, as opposed to the Department of Health, where cannabinoid hemp was formerly housed. This restructuring and associated regulatory authority given to the FDA will more than likely require products be made under cGMP conditions as governed by the Code of Federal Regulations ("CFR") Title 21 Parts 111 and/or 117 as applicable for the product type. Currently, New York is the only state that requires Good Manufacturing Practices certification in order to maintain processor licensure. While requiring GMP is a move in the right direction, increasing quality control and standardization, full FDA regulation is likely to create an adversarial environment for regulators and operators with divergent missions and incentives, inappropriate and detrimental to the marketplace as a whole. Here is a copy of the New York State Office of Cannabis Management's public comment on the proposed #rescheduling of #cannabis under the Controlled Substances Act. In addition to requesting new guidance similar to the Cole Memorandum, the public comment contains a plea to address the differing treatment of intoxicating hemp-derived products and cannabis under federal law. Specifically, #OCM writes in its public comment that: "The current misalignment of the treatment of cannabis and hemp-derived intoxicating products is untenable for state regulators. States require clarity to set product quality control standards for all cannabis products, regardless of whether they were originally derived from hemp or cannabis. This is a major public health concern as similar products are operating under different regulatory frameworks creating significant confusion for regulators, businesses, and cannabis consumers." #cannabisnews #cannabislaw
