The Same Job, Same Pay provisions of the Fair Work Act 2009 commenced on 15 December 2023 and enable the Fair Work Commission to make a regulated labour hire arrangement order, meaning labour hire workers will receive the same ‘rate of pay’ as host employees covered by an enterprise agreement (or other prescribed instrument) at the workplace, when undertaking work covered by that agreement. HOLD ON – THE ROLLER COASTER RIDES AGAIN Navigating our ‘New Normal’ – construction July 2024 The Fair Work Commission has announced a 3.75% increase to the National Minimum Wage from 1st July, 2024. The national minimum wage now increases to $915.90 per week, or $24.10 per hour. The minimum superannuation guarantee also increased to 11.5%. The Fair Work Commission cited cost-of-living expenses as the primary reason for the increase. This year’s increase is smaller than the 5.75% increase that occurred in 2023, with the Fair Work Commission noting that inflation has started to decrease, and many employees will soon receive the benefit of tax cuts and other cost-of-living relief measures. Please note that there is not necessarily an obligation to pass on a wage increase to all employees. Each year, an Expert Panel of the Fair Work Commission (a separate agency to us) reviews the National Minimum Wage and minimum award rates to decide if they should be increased. This is known as the Annual Wage Review (AWR). The review usually happens between March and June. The Expert Panel must consider submissions from organisations and individuals, any commissioned research and the minimum wages and modern awards objectives in the Fair Work Act. At the end of the review the Panel issues its decision. If your employees’ minimum pay rates change because of the AWR, the new rates will generally apply from their first full pay period starting on or after 1 July. It’s important to remember this can affect minimum wages for your employees covered by an enterprise agreement, as the base pay rate in an agreement can’t be less than the base rate in the relevant award. The Fair Work Commission announced an increase to Australia’s minimum wages for award-free and award-covered employees of 3.75% to take effect from 1 July 2024. For award-free employees this means the new minimum wage will be $915.90 per week (based on a 38 hour week) or $24.10 per hour. Casuals are entitled to a 25% loading on the hourly rate. Young award-free employees (those 20 years and under) receive a percentage of this rate, depending on their age. For award-covered employees the new minimum wages will be set out in the awards themselves, and the Fair Work Commission will publish “draft determinations” of the new award rates shortly. These will be published on the Fair Work Commission’s website here. The Fair Work Ombudsman will also be updating their Pay Guides for each award in the coming weeks, which can be viewed here. Only some awards provide for lower rates for young employees, whilst many dictate the same minimum rates apply regardless of the employee’s age.
