Should a mediator make suggestions in a mediation? In the NMAS model, a facilitative process is preferred and mediators are there to facilitate the process, not provide solutions. As the feedback below shows, I do find that presenting possible solutions can be very helpful, particularly where the parties are really stuck. The way that those suggestions are put is important though. When I offer a solution in a mediation, it is generally prefaced by "What would it be like if you ..." or "How might it work if ...". The suggestion is put out there but in a way where the party is free to take it on board or not. How have you seen mediators make suggestions? Do you see it as part of their role? #negotiation #mediation #commercialdisputes

When you’re looking for solutions, remain open minded. Mediation provides the opportunity for parties to find a solution which works for them. During mediations, we ask for individuals to be willing to find common ground, explore creative solutions and be open to compromise. This open-minded approach to collaboration and creative problem-solving then leads to lasting, tailored solutions which satisfy both sides. Mediation or facilitated conversations – what’s the difference? Internal facilitation is valuable. It provides a great way to address low level conflicts within a business. Yet it typically lacks three core elements of true mediation. It isn’t: - impartial - voluntary - a protected conversation Using an accredited mediator ensures a fair, unbiased process, which can resolve complex issues quickly. My blog (link below) provides some insight into how internal facilitation and external mediation differ and when using an external route can be more beneficial for your business Did you realise that’s what mediation really is? It’s Monday, and you know what that means? Time for another Principle of Mediation. This week: Communication To quote management consultant, Peter Drucker, “The most important thing in communication is to hear what isn’t being said.” Keeping a dialogue open between two opposing sides can be incredibly challenging, but a tactful and persistent neutral can always find a way to cut to the heart of the matter and reframe the conversation to keep things moving forward.
