Federal Marijuana Prohibition Faces Legal Challenge in Appeals Court A significant federal appeals court case is examining whether the longstanding prohibition on marijuana violates constitutional protections. Plaintiffs argue that enforcement of federal marijuana laws conflicts with individual liberties, states' rights, and due process. Our focus should be on cultivating a culture of mature exploration and enjoyment of plants and fungi that don't possess properties that are inherently harmful to humans and can actually be very beneficial with the above caveat. The harm more often than not stems from our own ignorance or immaturity, e.g. disregard for prudent dosing ranges based on experience, setting, etc. No different than alcohol, in that sense; just different plants and fungi with different effects. #cannabis #marijuana #legalizeit

There’s still no exact date when Mulrooney might rule on moving marijuana from Schedule 1 to Schedule 3 of the Controlled Substances Act, which would have profound consequences for the $32 billion legal U.S. cannabis industry. That long-awaited date appears to be no earlier than February, when some of the parties designated to participate in the rescheduling process indicated availability to give part of what might be a week’s worth of testimony. In the meantime, more filings in the proceedings are due Dec. 13, with documents due Jan. 3 – two “homework” dates that Mulrooney set Monday. “While this is undoubtedly a very positive first step, rescheduling will not end federal marijuana prohibition and doesn’t harmonize federal law with the laws allowing some form of legal cannabis in the vast majority of the states.
