I, Gulcin Kashano and Eilidh Moncrieff discuss the MAC review, and its impact on the forthcoming changes to the Immigration Rules on 14 March 2024. The Immigration Rules, which are expected to take effect from 4 April 2024, are likely to: 👉🏻 Increase the minimum salary threshold for Skilled Worker visas from £26,200 to £38,700 (or higher depending on the relevant SOC code). 👉🏻 Replace the Shortage Occupation List (SOL) with the Immigration Salary List (ISL), resulting in fewer salary discounts 👉🏻 Adoption of SOC 2020, from SOC 2010, and reliance on ASHE 2023 data (rather than ASHE 2021) for going rates, which is likely to result in higher salary thresholds for both existing and new workers. 👉🏻 Retention of the new entrant discount, for those aged under 26 years old. Any employers intending on sponsoring workers below this threshold, must ensure that certificates of sponsorship/applications are submitted prior to this date.

The Statement of Changes to the Immigration Rules have now been published (https://lnkd.in/e6Hh6CK7). In summary, the rules confirm: ☛ the increase of the general threshold for Skilled Workers from £26,200 to £38,700. ☛ the increase of the general threshold for Global Business Mobility visas from £48,500 ☛ Reliance on SOC 2020, this will mean that many codes now have different numberings, names, and a higher minimum salary ☛ The replacement of the Shortage Occupation List with the (shortened) Immigration Salary List (ISL) – inclusion on the ISL means a reduced salary threshold applies. Importantly, the rules confirm that any applications made using a Certificate of Sponsorship issued before 4 April 2024 will be decided in accordance with the rules in force on 3 April 2024. As such employers should consider assigning Certificates of Sponsorship and/or submitting any potential applications which do not meet the updated rules as soon as possible, or before 4 April 2024. The above-list does not incorporate all of the changes, which are nearly 300 pages long.
