Socio-politico activism is verily a cumulated agenda, this may be to control the inner sentiments of common masses, which are instantly not curated, if a legislative realm is not implemented in true spirit then obviously common laws and regulations will not be restained, thus for good governance and adherence continuity, it's important to enhance the capacity of institutions. 📑 The newly elected Special Rapporteur on the promotion of truth, justice, reparation, and guarantees of non-recurrence at The United Nations Human Rights Council (UNHRC), Bernard Duhaime, in his first report pointed out that "the influence of social networks, artificial intelligence and the transmission of disinformation makes the growing global challenge of #denialism and #revisionism of past human rights violations rights worse". Some of the worrying circumstances within the judiciary include, among others, the lack of progress in criminal prosecutions, as well as the refusal to prosecute or extradite persons charged with crimes against humanity. In terms of reparations, the biggest obstacles include the lack of compensation programs and compensation legislation, and the inability to provide compensation to the families of victims of enforced disappearances. According to the report, one of the significant steps for the implementation of transitional justice is the trans-disciplined usage of "a whole range of judicial and non-judicial measures", which includes relying on social, natural and applied sciences as well as the arts. On December 3rd, the #ECHR, in Yevstifeyev and others v. Russia, found that domestic authorities’ failure to comply with the positive obligation to respond adequately to homophobic-motivated physical threats and verbal assault by a politician to LGBTI applicants constitutes a violation of Article 14 of the Convention taken in conjunction with Article 8, the right to private and family life. This decision further reinforces the Court’s stance in Hanovs v. Latvia that the failure to address hate-motivated incidents can normalise hostility towards LGBTI individuals, perpetuate a culture of intolerance and discrimination, and encourage further acts of a similar nature. Both of these judgements serve as a recall of the State’s positive obligations in effectively addressing hate crimes against LGBTI people, especially amidst the rise in hate incidents in a number of countries within the Council of Europe. I have a question for the law scholars… we know that all people have the right to access medical resistance against occupying power “irrelevant of religion, skin color, ethnicity, their funding or lobbying power”… however: - What are the rights of people who want to support that resistance? - What’s the responsibility of nations in helping that resistance? “sovereignty is a right, but is it ok when a genocide is being acted at the boarder?” - What’s the stance on complicity with the occupiers? Lastly, what are the tools to raise these rules not only internationally “when they can’t be enforced” and in national justice systems to hold any into account “signed international treaties or agreements that force them to act”?
