As we come the end of national descriptive trade mark week, I thought I would bring together the highlighted cases and see if we can make some sense of the decisions which don't at first sight look entirely consistent. It’s not always clear which side of the line a trade mark which consists of two conjoined descriptive words will fall. If I can offer some guidance, it’s this: I know what a FLUSH SEAL is. I’ve a pretty good idea what BRAIN TEA is. But I am not sure what I would get if I were buying a LOVE HUG! The test of descriptiveness in the UK and EU is applied forward, is ‘X too descriptive of Y goods or services?’ but a useful, practical sense check is to look at it backwards and ask –" do I know what an X is, and is that what the trade mark is trying to protects?". If we were being cynical we might suggest that, this is what some judges do in practice. I think looking backward rationalises these cases. I can see FLUSHSEAL is just a flush seal and I can see how BRAINTEA sounds like a tea containing a supplement for the brain, but I can't see what I'd be getting if I bought a LOVEHUG. Commercially, if you conjoin to words to get your message across quickly that makes sense but you may have trouble protecting it. There's nothing inherently wrong in that, there are good reasons by trade mark attorneys aren't brand directors! Photo credit: Etienne Girardet
