As the cannabis industry matures, we are starting to get reliable data. This can help make decisions based on real sales figures and not predictions. 10 years ago, there was only one state with adult use sales (#colorado) and a handful of states with medical seals. Now there is 24 sates with adult use sales and an additional 15 states with medical seals. At the moment #california leads with total seals but #michigan leads with per capita seals. #florida leads in medical seals. #missouri with a relatively small population and only 17 months since they launched their adult-use market, is already in fifth place. The Tides are turning! I am proud of each client Seed Talent is privileged to partner with but I want to give a special shout-out/thank you to Wyld! A market leader for quite some time, Wyld has been working with our team on their recently revamped national brand training. While many brands in the industry are struggling to understand their differentiation and ultimately articulate that into a commercialization plan, it is so refreshing to see certain brands invest in doing things the right way. Budtenders feel the difference between training that is slapped together vs. those that are invested in and done right. In the first quarter of 2024, with federal cannabis-reform efforts not yielding any practical changes, Curaleaf made a strategic decision to enter the hemp market. This is a trend we are starting to see. Cannabis can only be sold in the state it was produced and only allowed to be sold through dispensaries (in a hand full of states such as #california it could be sold through a delivery service). Intoxicating products that derived from hemp, are legal to ship across state lines, are available via e-commerce and mainstream retail channels. As well the producers of the products do not need to comply with burdensome licensing requirement and predatory taxation. A lot of politicians say that they support small businesses, but for small cannabis businesses to be able to properly compete, they need to have access to the same distribution channels as #hemp. It has been almost 11 years since #colorado started adult use sales. Now the vest majority of americans live in a state where cannabis is legal for medical or adult-use. We are starting to get reliable data. Data about consumer behavior is really important. New Frontier Data conducting a survey on the difference between people that use cannabis medically versus recreationally. They found that medical patients are typically are the most loyal customers and spend far more than adult use consumers. Adult use consumers are the most likely to obtain their cannabis for free and the most likely to spend under $50 when they do buy cannabis. Medical patients are the most likely to spend $400+ when they purchase cannabis. This reflects the need of medical patients to have consistent access to the same products. A new set of criteria for qualifying for a public convenience and advantage waiver was proposed at today’s Cannabis Control Board meeting. The criteria include the following: 1. Distance from Other Retail Dispensaries: The proposed location must be at least: - 1,000 feet from any existing retail dispensary in jurisdictions with a 1,000-foot minimum distance requirement. - 2,000 feet from any existing retail dispensary in jurisdictions with a 2,000-foot minimum distance requirement. 2. Geographic, Structural, or Topographic Barriers: The existence of barriers (such as waterways, major roadways, highways, or significant travel distances) that separate the proposed location from existing dispensaries. 3. Travel Distance: The actual distance between the proposed location and existing dispensaries, as measured by pedestrian or vehicle routes. 4. Unique Factors of the Proposed Location: Factors that may justify the location, such as: - High consumer demand for additional retail dispensaries or microbusinesses. - The presence of illicit or former illicit cannabis dispensaries near both the proposed and existing locations. - Other relevant factors that may support the need for greater access to adult-use cannabis in the area. 5. Notification to Local Authorities: The licensee must send a notification to the local municipality or community board, informing them of their intention to request a waiver from the Board for not meeting the 1,000-foot or 2,000-foot minimum distance requirement. The municipality or community board will have 45 days to respond before the Board considers the application. Mr. Kagia mentioned that the Board would consider more than this information alone when deciding to grant a waiver and that it would be up to their discretion. Chairman Wright raised concerns about the 45-day period, and the Board voted to approve the criteria with an amendment for licensees who have already received municipal support.

The LITTLE stuff Matters BIG. Product subcategory nuances get overlooked today. These gaps are where we find ways to win, so I hope my thoughts here helps some of you! Consumption format, packaging, ingredients, etc… Everything matters, and some way more than others, depending on the overall category. This is where the uniqueness for brands can really get granular. The trick is to do without confusing the customer! Instead, you have to lean into what you’re good at, but with unique points of differentiation — that solve the most important problems for the sub-demographic you’re targeting. It’s harder than it looks and I’m always amazed at what some of the great brands out there can do here. Some like C4, are inspiring. It all comes down to messaging and marketing what the differences are, and why you have these “other options”. What do my fellow cpg brand people think?? F the Treaties: Rescheduling and Marijuana-Particular Controls https://lnkd.in/gwnhJv2Z <a href=""> - Marijuana-specific controls in schedule III? The drug Enforcement Administration (DEA) revealed its Discover of Proposed Rulemaking (“NOPR”) final week to a lot fanfare. The NOPR would reschedule marijuana, “marijuana extract” and “naturally derived delta-9 tetrahydrocannabinols” from schedule I to schedule III of the Managed Substances Act (CSA). However that’s not all. In my very fast evaluation after the rule dropped, I flagged DEA’s assertion that it might develop “marijuana-specific controls” together with rescheduling. I’m shocked this DEA assertion hasn’t spurred a lot dialogue, regardless of its Easter egg placement at NOPR web page 86. “Marijuana-specific management” guidelines might turn into a reasonably large deal. For context, the U.S. is a celebration to sure worldwide treaties that require it to regulate hashish and different drugs. Due to that obligation, the Division of Justice’s Workplace of Authorized Counsel (OLC), has suggested DEA that extra controls could also be wanted for marijuana on schedule III. That’s the best method to clarify it: if you need extra element on the whys and wherefores of the authorized regime and OLC’s rationale, go to pages 83-87 of the NOPR. In my publish final week, I highlighted that marijuana-specific controls could be thought of by DEA “concurrent with this rulemaking.” In different phrases, DEA is saying, “we’re taking a look at adopting new and particular guidelines for marijuana, past simply shifting it to schedule III. However we don’t know what these new and particular guidelines could be but. Keep tuned.” This strategy is artfully imprecise and noncommittal, and awkward, and begs examination. The trail to marijuana-specific controls I’m not an administrative legislation knowledgeable. Nonetheless, my understanding is that DEA could be required to note any proposed, marijuana-specific management guidelines within the Federal Register and open them up for remark. In different phrases, the method would mirror what we simply noticed with final week’s NOPR. If this occurs, it is going to be attention-grabbing to see what the “particular controls” guidelines present. To that finish, I’m not conscious of any such guidelines for different schedule III drugs. As a substitute, there are solely basic controls relevant to all schedule III drugs: e.g., sure storage necessities, allowances for paper or phone prescriptions, refill caps, and many others. None of that appears relevant to e.g. marijuana flower, which isn’t authorised by FDA for something. Alternatively, what might these guidelines probably say that might matter, particularly with respect to state marijuana packages? Would anybody, outdoors of scientists learning marijuana, pay any consideration to a DEA’s “particular controls” for sched...
