Probably 70% of my recruiting practice is for BigLaw. That may be lower than many of my MLA colleagues. Why do I do so much work with mid-sized and smaller firms? A few reasons. In California we are spoiled for choice when it comes to boutiques -- both subject matter focused firms, and full-service boutiques are local institutions here. So, there are a lot of options! A lot of people don't want to work in BigLaw anymore/again/ever. My job is candidate-focused, so it's my job to find a role that matches what people want. It's definitely not my job to wedge them back into BigLaw because I don't have other options to offer them. In the last week MLA has begun a relationship with 3 new boutiques in Northern California, and the list grows all the time. Smaller firms allow associates to broaden out their practices -- their litigation teams do ALL kinds of work, because they don't have critical mass to have specialist strike teams. This model exists across corproate too - smaller firms' corporate teams may include M&A, ECVC, funds, tech trans... Being a generalist is appealing on its face but is also a great path to an in house role. Many, but not all, smaller firms offer better work/life balance. They may also be a more comfortable format for lawyers who want to know their colleagues more closely. So, don't rule out a smaller firm -- you may be surprised if you speak to them at just how much it sounds like the right fit.

From Legaltech News: "On Thursday, litigation analytics provider Pre/Dicta announced the expansion of its litigation analytics platform to cover California's Superior Courts, marking the company's first move into state court analytics. "Pre/Dicta uses a diverse array of data sources to predict the length of the various phases of a matter, as well as the likelihood of success for several motion types. The brain is the new privacy frontier: Responding to developing technologies in the neurotech space, a number of American states have amended their privacy laws to include "neural data" in their definition of sensitive personal information. Some require opt-in consent for its collection, others simply the possibility for a data subject to opt out. Some have included employees' neural data in the definition, others not - with varying implications for privacy protection:

The CA Attorney General's Office has reached a $500K settlement with Tilting Point Media for violating the CCPA and COPPA. Tilting Point collected and shared children's data without proper consent. The Tilting Point settlement offers valuable lessons for companies, particularly those dealing with children's data: Prioritize Transparency: Ensure clear and conspicuous privacy notices that detail data collection practices, use, and sharing. Obtain Verifiable Parental Consent: Implement a system to obtain verifiable parental consent before collecting any personal information from users under 13.  Online Tracking Consent: implement a system to obtain proper opt-in consent before collecting any personal information from users under 16.  Review Third-Party Relationships: Carefully review data-sharing agreements with third-party vendors, especially those involving user data. The Tilting Point settlement is just one example of the growing focus on data privacy, particularly when it comes to children. With CCPA enforcement on the rise, and similar laws being enacted across the US and internationally, companies must prioritize data privacy compliance. New Ruling on Punitive Damages and Attorney Fees in California Invasion of Privacy Act (CIPA) Case As Thompson Hine has previously reported, the recent surge of privacy claims under the California Invasion of Privacy Act (CIPA) related to using website cookies, pixels, and web beacons continues to impact a several sectors. It has been especially harmful to small businesses. On July 15, Judge Rolf Treu ruled on a preliminary motion in a CIPA lawsuit and concluded that the plaintiff could potentially recover punitive damages and attorney fees. Although this case does not address the merits of whether website tracking technologies are considered pen registers or trap and trace devices under CIPA, plaintiffs may rely on it to demand larger awards and settlements in their CIPA actions. Businesses that deploy these types of online tracking technologies should immediately reassess the legal terms governing the use of their websites and whether they contain favorable dispute resolution provisions, such as remedies available for claims arising from a consumer’s use of the website. This is a good post that highlights 15 of hundreds of regulatory and legislative actions related to AI. Since so many laws impact the use of AI that are focused on AI, it is imperative to remember that all existing statutes and regulations be analyzed through an AI lens. All companies and family offices need to recognize the full universe of potential legal implications.
