📣 After months of negotiations, the New York State Legislature enacted on April 20 the state’s 2024-2025 Budget, which represents the most significant state action on housing in several budget cycles and includes provisions regarding the “Affordable Neighborhoods for New Yorkers” tax exemption (otherwise known as “485-x”) to incentivize new multifamily construction, the Good Cause Eviction Law, incentives for office-to-residential conversions, authorization for New York City to raise the Floor Area Ratio cap, and an increase in the allowance for Individual Apartment Improvements for Rent Stabilized Units, among others. The Maryland Department of Labor recently issued guidance to address questions regarding the Wage Range Transparency law. The guidance provides information regarding which jobs the law applies to, job posting requirements, including a non-exhaustive list of benefits that must be included, and liability over third parties advertising job postings. There are distinct advantages at times to litigating in federal court. I look for ways to remove whenever I can. But when can you is the question? The Eastern District of New York recently provided a relatively short decision in Merrimack Mutual Fire Ins. Co. v. Home Depot U.S.A., Inc., with an interesting spin on the timing analysis. Many know that the monetary threshold for federal diversity jurisdiction is $75k in controversy. And many question when exactly they “know” the amount in controversy? Spoiler alert…while reserve estimates may play a role in knowledge, there is a more fundamental issue at play. Rather, procedurally, your 30-days to remove cannot commence until after service of an initial pleading under 26 USC 1446. A summons with notice here was insufficient and the setting of a reserve prior to service of the complaint could not be considered “other papers” establishing knowledge of the amount in controversy. #TheMoreYouKnow

🚨 New 3rd Circuit Court of Appeals Decision – Constitutional Law 🚨 On January 18, 2024, the 3rd Circuit Court of Appeals decided Madison M. Lara et al. vs. Pennsylvania, overturning restrictions on the ability of 18-to-20-year-olds to carry firearms outside their homes during states of emergency. The court applied the Supreme Court's two-step test from the Bruen decision, emphasizing the Second Amendment's historical context and recognizing young adults' rights for lawful purposes, including self-defense. This ruling is a significant affirmation of the Second Amendment's protections extended to young adults, establishing a precedent on the scope of gun rights for this age group. The Court's analysis rested on interpreting the term "the people" within the amendment and set a historical reference point for the Second Amendment's application based on its public meaning in 1791. New local Bergen County #LandUse case from 9/10/24. For all attorneys, developers, variance seekers and even Board Secretaries, this is a cautionary tale where approvals may get sent back to a Land Use Board by the Court if public notice was improper. While not absolute, a good preventative tip by an applicant is to ask the Board Attorney to confirm notice was proper so that same can be established on the record before proceeding into your application. Additionally, if you are a Board Secretary advertising a general public meeting, it is imperative your meeting notices are compliant with statute so the public is able to effectively participate in any public hearings being held by your Board. Here, the application for a height variance was re-approved after being sent back to the Zoning Board (to the credit of the applicant for a thorough presentation that withstood scrutiny), but the delays and extra costs and efforts that have been imposed upon the applicant and Board to have an application revisited may have been able to be avoided with more attention to public notice by all parties.
