The California Supreme Court’s recent ruling in Quach v. California Commerce Club Inc. provides a new standard for establishing a waiver of arbitration rights. Waiver can be established without a showing of prejudice to the party opposing arbitration. The focus is now on whether the party seeking to enforce arbitration acted in a manner inconsistent with the right to arbitrate. The Court shifted its focus to treating arbitration agreements like all other contracts thus eliminating procedural rules that once favored arbitration.
