The Medical Task Force on Anencephaly has defined anencephaly as the absence of a major part of the brain that subsequently limits human functioning without permanent mechanical support very shortly after birth. The condition is rare, however many have begun to study anencephalic infants in an effort to determine whether they can be used as organ donors for other needy infants. Answering this question requires looking at three commonly raised issues: what is “personhood” and can anencephalic infants be considered legal persons with all the legal rights personhood entails? How do we define death and should that definition be changed to account for anencephalic infants? And finally, what are the parents’ rights in all of this, considering these infants are minors and therefore cannot consent to organ donation themselves? This note addresses each of these questions in an effort to show that using anencephalic infants as a source for organs is not a viable option for our society at this point in time.
