Motions for reconsideration are used in New Jersey under the right circumstances. A motion for reconsideration is a legal document filed after a court decision that allows parties to ask the judge to reconsider the outcome of a case. However, they cannot be used just because a party disagrees with the Judge’s decision. Motions for reconsideration can only be filed if there is a clear demonstration that the judge’s decision has fallen into a specified category of error.   Legal News on Red Light Cameras on Long Island!   On November 27, both Nassau and Suffolk had Appellate Division rulings, which declared: “imposition of a monetary liability for a red light camera violation in excess of $50, or $75 with a late fee, is ultra vires, unconstitutional, preempted, void as a matter of law, or otherwise illegal…”   This means it’s possible that if you paid any additional fees, you may be entitled to seek a refund of any excess fees (and before you ask, no, our firm does not handle those collections).   Most notably, Suffolk County announced that they are doing away with the Red Light Camera program ENTIRELY.  There’s some data that shows while the cameras reduce intersection collisions by like, 10%, from people running red lights, there is like, a 9% increase of rear end collisions, from people slamming on the brakes to avoid the red light camera ticket. The new OPRAH law will permit fee shifting if a party is successful in opposing it. This is not a healthy way to proceed in my view and will create unnecessary financial burdens on a member of the public seeking information to which they are entitled. Fee shifting only is permitted by statute, court rule or agreement between the parties. In my view this is an unwise implementation of fee shifting and will hurt the free access of information. There are other and better ways to derail overzealous OPRAH requests, such as not permitting them when a litigation related to the request is pending. We need less onerous means to oppose overly burdensome OPRA requests than fee shifting.

Motion practice allows a litigant to formally request the Court enter an Order providing relief for issues they have been unable to resolve amicably with their partner/spouse/co-parent.
