We already know the DOT doesn’t play around when it comes to drug and alcohol testing. Whether you’re a driver, dispatcher, or fleet owner, understanding the rules is key to staying compliant and avoiding headaches down the line so let's get to it: - Pre-Employment Testing Before you can hit the road, drivers, you’ve got to pass a drug test. No exceptions. Fleet owners, it’s on you to ensure this is done before anyone’s behind the wheel. - Random Testing Once you’re in, random tests will happen, and they should. This isn’t about catching anyone off guard—it’s about keeping everyone on their toes and ensuring safety on the road.   Fleet owners, make sure you’re working with a Consortium to manage these tests efficiently and stay within DOT guidelines. - Post-Accident Testing Saying it here again, if there’s a crash (especially if there’s a fatality, injury, or tow), post-accident drug and alcohol tests are a must. Drivers, get it done within the 2-8 hour window, and dispatchers, make sure it’s lined up and documented right away. - Reasonable Suspicion Training Dispatchers and fleet owners, do you know when to request a drug or alcohol test based on reasonable suspicion? Make sure you’ve completed Reasonable Suspicion Training so you know the signs—slurred speech, erratic behavior, bloodshot eyes. - Return-to-Duty (RTD) Process Drivers, if you fail a drug or alcohol test, it’s not game over, but the road back isn’t easy. You’ll have to go through the Return-to-Duty process with a Substance Abuse Professional (SAP). After evaluation and any required treatment, you’ll need to pass an RTD test to get back behind the wheel. And even then, you’ll be subject to follow-up tests for a while. - Clearinghouse Compliance Fleet owners, this is a big one—make sure you’re registered and active in the FMCSA Drug & Alcohol Clearinghouse. This database tracks violations and tests in real-time. Before hiring, you must run a query in the Clearinghouse to make sure the driver’s good to go. Skipping this step is a quick way to land in hot water with an audit. Drug and alcohol testing is about more than ticking boxes—it’s about safety. For drivers, it’s your responsibility to stay clean and follow the rules. The dispatcher made a promise to the customer and you the truck driver will keep that promise. If that means going over on your hours of service that is OK, the dispatcher has your back. If you get caught and get a massive fine, is the dispatcher going to tell the trucking company to take it from their pay? If you are out of hours and involved in an accident, is the dispatcher going to notify the police that they authorised you to keep driving and ask all penalties to be applied to them? Slowly the FMCSA is actually starting to hold these fraudsters accountable. "I will charge you for trailer repair and late delivery." We accepted a preloaded trailer from a reputable broker. Upon inspection, we found that the trailer was damaged and required repairs. After notifying the broker, he assured us that the trailer was still drivable and advised us to take it to a repair shop, stating that the payment would be made via com check. Following his advice, the carrier paid $700 for the repair using a com check. However, after completing the delivery, the carrier had to return the trailer within five days. Due to unforeseen circumstances, we were unable to return the trailer on time. I communicated with the broker, who granted us an additional day for the return. We delivered the trailer, and everything seemed settled. Three months later, the broker raised the issue with the carrier, resulting in a chargeback invoice of $1,020 from the carrier’s factoring company, which included $770 for the trailer repair and $250 for late return fees. When I reached out to the broker, he claimed he couldn’t assist further and directed me to the accounts department. The account representative stated that we had failed to inform them about the delayed return and would be responsible for both the repair and late charges. I insisted on resolving the matter through a conference call with the broker and the account representative. I explained the entire situation and provided email and com check screenshots as proof. The case was placed under review, and after four days of continuous follow-up, I finally received a response. Brokers these days are pushing carriers for no reason or some nonsense arguments. If you are on the right side, play safe on behalf of your carrier and get what is yours. #truckingindustry #dispatch
