The Department of Labor updated the Fair Labor Standards Act (FLSA)'s overtime pay requirements and raised the minimum salary threshold for exempt workers to $43,888 on July 1, 2024. Ouch! The harder news? That threshold will increase again on January 1, 2025 to $58,656 (with further increases over time). That means that millions of previously EXEMPT employees that were ineligible for overtime pay could become "overtime eligible" if they earn less than these threshold salaries. The best way to approach this as an employer before the new year is to: (1) Identify all exempt employees currently earning less than $58,656 per year; (2) Conduct a self-audit of those particular exempt workers to ensure that they are classified properly. Those classified incorrectly could be reassigned to NONEXEMPT status, potentially avoiding the need to raise their base salary to the $58,656 minimum to remain exempt. It's confusing, and my 95-page "FLSA / Wage & Hour Toolkit" explains and provides sample tests and templates for the 5 Exemption Categories and how they work so that you can reclassify those employees properly, potentially avoiding large payroll increases to employees who should otherwise be nonexempt. You can then share those completed classification analysis worksheets with your employment defense attorney under attorney-client privilege for review before finalizing any classification changes. FLSA Thresholds: Changes to FLSA Salary Thresholds Effective July 2024 and January 2025 The U.S. Department of Labor has announced significant changes to the Fair Labor Standards Act (FLSA) salary thresholds. These changes will impact the exemptions for executives, administrators, and professional employees from minimum wage and overtime pay requirements. Key Changes ·        Effective July 1, 2024 – the salary threshold will increase from the current $35,658 per year to $43,888 per year. This equates to an increase from $684 per week to $844 per week. ·        Effective January 1, 2025, the salary threshold will increase to $58,656 per year, which is equal to $1,128 per week. Impact on Workers These changes will expand overtime protections to lower-paid salaried workers. The Biden-Harris administration has emphasized that this rule will ensure that workers who work more than 40 hours a week are paid more for that time. Future Changes The final rule also provides for future updates of these levels every three years to reflect current earnings data. These changes are significant and will impact many businesses and employees. Employers should review their current payroll practices to ensure compliance with these changes.
