🚨🚨 Department of Labor (DoL) just released a notice announcing another update to the minimum wage rate for those working on or in connection with Federal contracts covered by Executive Order 14026, Increasing the Minimum Wage for Federal Contractors. Beginning on January 1, 2025, the NEW MINIMUM WAGE for workers performing work on or in connection with covered contracts will increase to $17.75 per hour. Got an EB-2 NIW RFE last week for a pilot client. I was honestly surprised to get an RFE for him considering the strength of his profile (I’ve been able to get approvals for many of his peers - their profiles are not quite as strong). Looks like the officer is preparing  to deny the case, and we may need to refile. This kind of thing also happened with one of my strongest cases recently. Sometimes the “weak” ones go through with no RFE, and the strong ones get challenged. Yes, USCIS can be arbitrary with its decisions as different officers can have different standards for the same immigration benefit - in this case, we drew a strict officer with very high standards for EB-2 NIW. The officer is saying my client needs to show that he has been “an impetus for progress” in his field by contributing to the entire field. This isn’t a requirement for EB-2 NIW. Today the ISR Task Force partnered with WTOP News, the Federal News Network, U.S. Indo-Pacific Command, United States Space Force, and Planet Federal to discuss the critical topic of Broad Area Management and its impact on the safety and security of our nation. In the round table discussion, we touched on the imperative of #teamwork in Integrated Deterrence while also discussing some of the more tangible ways the services are investing in solutions to deliver enhanced situational understanding around the world. The US Army Intelligence enterprise, under the direction of Lieutenant General Tony Hale, is working hard to deliver horizontally integrated capabilities at a pace and scale that matches the tempo of the modern operational environment. To optimize these systems, we’ve been directed to develop strategies for wide-adoption and implementation of Artificial Intelligence capabilities into human-centric workflows. Soon the world currency will be measured in TPUs and GPUs. #Data centricity is a thing, and embracing it is what separates visionary leaders from everyone else. We wrap up this week with a conversation with Congressman Ken Calvert (R-CA) - a partner on Capitol Hill who is “all in” on AI investments.

United States Department of Defense (DOD) - New Defense Logistics Agency (DLA) Strategic Plan Frames Goals for 2025-2030 The DLA has released its new 2025-2030 Strategic Plan, "DLA Transforms: A Call to Action." The plan outlines four imperatives, each with corresponding objectives. The imperatives are: People — Build organizational agility through our people and culture. Precision — Calibrate resilient and responsive logistics solutions in support of military readiness. Posture — Enhance support to integrated deterrence across the continuum of conflict in contested logistics environments. Partnerships — Lead logistics interoperability across the department, allies, whole of government and industrial base. The objectives under the People imperative include defining clear, mission-driven standards for operating amid contested logistics and building workforce skillsets that reflect those standards. Training exercises will help refine procedures. MilitaryChildCare.Com is live with information on the pilot (link below) and the JTR was updated October 1st to reflect these changes. Expenses now covered include transportation costs for a designated child care provider (such as a family member who travels to the PCS location to provide care when there is no availability at a CDC). Our DoD senior leaders and industry executives shared diverse perspectives on contested logistics, the modernization and optimization of our supply chains, and the strategic importance of logistics as a deterrent. These insights reinforced a powerful truth: logistics isn’t just support; it’s an integrated capability that keeps our forces mission-ready. The message couldn’t have been clearer: we have to be ready NOW. Leveraging AI and data analytics for decision-making and responsiveness in our supply chains isn’t just an advantage—it’s essential. As warfighters, each of us has a critical role in ensuring mission success. Whether on the front lines or behind the scenes, we are all part of this effort to stay proactive and prepared for the challenges ahead. This conference was a call to action. Our readiness and logistics capabilities are a decisive factor in keeping our forces equipped, supported, and strategically positioned for whatever comes next. On October 4, 2024, Congress enacted the Customs Trade Partnership Against Terrorism Pilot Program Act of 2023 (the “Act”). Pursuant to the Act, Congress has authorized a pilot program for two new classes of entities to participate in the Customs Trade Partnership Against Terrorism (“C-TPAT”). The pilot program will be available to: -- (1) non-asset third-party logistics providers arranging international transportation of freight and licensed by the Department of Transportation (“DOT”); and -- (2) asset-based third-party logistics providers facilitating cross-border activity, licensed by the Federal Maritime Commission, Transportation Security Administration, U.S. Customs and Border Protection (“CBP”), or DOT, and using its own warehousing assets and resources to manage logistics services. No more than ten entities from each class will be chosen to participate in the pilot program, which is to last for not longer than five years. The goal of the pilot program is to determine if allowing these entities to participate in C-TPAT would enhance security. At the end of the pilot program, CBP will issue a report to Congress assessing the participation of the chosen entities and making recommendations. At this time, CBP has yet to make any statements related to the pilot program, but the Act requires that CBP publish notice in the Federal Register setting forth requirements for the pilot program by October 4, 2025. Though the Act does not allow brokers to categorically participate in C-TPAT, it may provide the first steps for broker participation in C-TPAT—something the industry has been requesting for some time.
