I want to piggyback on a recent post by my friend Greg Raiten who is co-founder of The L Suite (TechGC). Greg shared a post (link in comments) that illuminated early legal hiring in startups and how to evaluate a company’s view of the role. Greg noted that often a company says they want a GC but they actually want a commercial lawyer. I think there’s a third situation: they know they need a GC and have the right strategic framing for the role. But, they don’t really know what that means for the organization, what will happen when the GC is there. It means change. It’s a real sea change to have a GC. I think it’s important to dicuss and plan for how the organization and leadership will handle that as you jump in.

In a rare move from the federal level, members of Congress wrote CA Governor Newsom to veto California’s SB 1047 – the Safe and Secure Innovation for Frontier Artificial Intelligence Models Act. The letter notes the "severe burdens this bill proposes on AI developers and deployers". CA State Senator Weiner, who is the main sponsor of the Bill and represents San Franscico (the Bay area is the bastion of AI development) believes a CA bill is needed because "[w]e can advance both innovation and safety; the two are not mutually exclusive" and believes there is AI regulation gridlock in DC: "aside from banning TikTok, Congress has passed no major technology regulation since computers used floppy disks — California must act to get ahead of the foreseeable risks presented by rapidly advancing AI while also fostering innovation." He may be right on DC gridlock - but having 50 states with differing AI regulation is not the way to go. Senator Weiner has done some amendments to #SB1047 in response to tech community concerns, such as taking at the perjury charges an AI developer might face if they certified the model as reasonably safe and it later caused harmed. Unfortunately, the bill focuses on grandiose worst case scenario risks and ignores the more common risks such as nonconsensual deepfakes, misinformation and misrepresentation regarding a model's capabilities. Scientific safety is important, but it should be related in reality and not Philip K. Dick SciFi dystopian lit. #VetoSB1047 #AI #ArtificialIntelligence #Regulation #Tech

Today, California Governor Newsom signed SB 1223 into law, such that California will recognize neural data as a category of sensitive personal information. Below is our updated sensitive data comparison chart. In addition, Governor Newsom has (to date) taken the following actions on the bills we have been tracking: ➡️Signed: SB 942 (California AI Transparency Act) AB 1008 (personal information in AI systems) AB 2013 (generative AI training data transparency) AB 2885 (definition of AI) ➡️Vetoed: AB 3048 (opt-out preference signals) AB 1949 (kid’s privacy) We are still waiting on SB 1047 (“Safe and Secure Innovation for Frontier Artificial Intelligence Act”) and AB 1824 (Recognition of Prior Opt-Outs in M&A Deals).

The irony of client side GTM tags with the new CIPA (wiretap) law is an amazing catch-22. 1. you can't set consent w/o initializing GTM 2. if you initialize GTM to set consent, then you already are liable Are folks writing header code to load banners before GTM is loaded?? Would love to hear thoughts from folks who use GTM and understand the challenges with consent mode.
