Going to be a lot of wet high rise buildings in Houston if Beryl🚩gets his act together once back out over the Gulf of Mexico… could reach Cat 2 hurricane by landfall in Texas. If you have lived in North Texas during the past couple of summers, you know we are almost always in some phase of water use restrictions. Hopefully, a new source or even two will help as the Metroplex area continues to grow. I think the next step is going to be promoting more drought resistant yard & landscape planting. AUSTIN – (July 23, 2024) – The Texas Water Development Board (TWDB) today approved by resolution financial assistance in the amount of $320,845,000 in multi-year Board Participation financing from the State Water Implementation Fund for Texas (SWIFT)* program to the Upper Trinity Regional Water District (Fannin, Collin, Cooke, Dallas, Denton, Grayson, Hunt, and Wise counties). The District will use the assistance for the construction of a water supply project. Due to an escalation in construction costs, the District requested additional funds to continue construction of Lake Ralph Hall reservoir in Fannin County. The reservoir will provide a firm yield of approximately 39,205 acre-feet and up to an additional 21,283 acre-feet of indirect reuse to meet projected water demands. The TWDB has previously committed $513,580,000 to the project.

Houston / Harris County law enforcement Officers are starting to tell property owners, managers, and security Officers that only they can arrest for criminal trespass. NOT TRUE! As a property owner, you have the right, under Texas law, to use force (Penal Code 9.41) to prevent trespass or to remove someone from your property. Security Officers have up-to the same, acting in your behalf. If the trespass is or becomes a breech of peace (not specifically defined in code) for you, that is also an "arrestable offense," under CCP 14.01. IF an individual enters or remains on your property, refuses to leave, and that is a problem for you, that would be a breech of peace. There is case law after case law that supports this. Just because the current Harris County DA's Office has no spine and continuously refuses to back the rights of citizens, doesn't mean it's any less legal to exercise your rights.

Something I wrote 7 years ago. Here is what I am seeing so far regarding flooding in the Houston area from Harvey. Elevation Certificates recently performed by me indicate that places along Buffalo Bayou had flooding as much as 6 to 7 feet above the 100-year flood plain elevation. Areas in Bellaire and Meyerland received as much as 1 foot or more above the 100-year flood plain elevation. Certain areas northwest of 610 had flooding more than 1 foot above the 100-year flood plain elevation. I performed an Elevation Certificate a few months ago for my office landlord who owns several strip shopping centers here in Houston. He had recently purchased another one and while he had an Elevation Certificate performed by another firm for the closing, he had me do one for him anyway. I found the buildings 2' lower than the 100-year flood plain whereas the other Elevation Certificate showed it just above the 100-year flood plain. The problem with these Elevation Certificates is that the owners of the properties at risk of flooding have no incentive to get an accurate Elevation Certificate because it has a direct bearing on the amount of money they pay in insurance premiums. The larger the risk (the lower it is in the 100-year flood plain) the more they pay in insurance premiums. Unscrupulous land surveyors have falsified some of these Elevation Certificates in order to gain advantage in the market against somebody like me that actually performs the work. I can't compete with them because they are cheaper and don't do any work. If I expose these frauds the people who relied on those Elevation Certificates potentially could be denied coverage by the insurance firms who issued their flood insurance policies leaving them to try and recover their damages from the crooks who took them in the first place. It is very frustrating and as I drive through these neighborhoods that suffered flooding damage and see signs on the corners saying, "Elevation Certificates, call...." I wonder what has happened to my profession. It seems a symptom of the recent broader deterioration in our society.

I have posted this before on education and posted on my facebook, but this year has been crazy all over the U.S. so it is a universal message. Over the weekend North Texas had some crazy storms! The first thing people normally do with storm damage is call their insurance company to claim the damage even it is a smaller claim the education that has been provided is to call them first. As a reminder if you have damage get a quote first before calling your insurance. Once a call is made to insurance a claim is made rather you meant to file one or not. I am seeing so many post on people looking for help on tree services, window damage, and the recommendation is to call the insurance company. Please don't do that; get quotes and make a decision if you want to call your insurance company or not. Claims are going up because of education on this! Carriers are saying no to writing new business in certain zip codes in Texas and denying new appointments completely in Texas to write new business they want out. How does our future look in insurance? Look at Florida, California, and Colorado. Let's do our best to minimize unnecessary claims! #insurance #themoreyouknow

Texas veterans with a 100% disability rating may be eligible for a variety of benefits, including: Property tax exemption Veterans with a 100% disability rating are exempt from all property taxes on their primary residence in Texas. Veterans with a disability rating of 70–100% may be eligible for a $12,000 exemption, while veterans with a rating of 50–69% may be eligible for a $10,000 exemption. To file for the exemption, veterans can complete the Application for Residence Homestead Exemption form and submit it to the appraisal district where the property is located. The deadline for filing is April 30, but veterans may be able to file up to five years after the delinquency date if certain conditions are met. VA medical benefits Veterans may have access to a large VA medical network, including free health care, prescription medications, and dental care. They may also be eligible for travel allowances to attend appointments at VA medical facilities or authorized health care facilities. Education benefits Veterans may be eligible for education benefits, such as the Hazelwood Act, which provides up to 150 credit hours of tuition exemption at Texas public institutions of higher education. No way that’s reasonable. You own a landscape business. You hired Josh as a general manager of the South Texas division. Josh signed a non-competition agreement when he was hired. Josh worked great for 2 years then recently left to a competing business. You called the Firm and want to enforce the non-competition agreement. Non-competes are enforceable if: 1) They are part of an otherwise enforceable agreement. 2) There was some value given to the employee (“confidential information/trade secrets can count”) 3) These things are reasonable: Activities which are restrained; the time; and geographic scope. Often, employers get tripped up on reasonableness. It is probably not reasonable to restrict Josh from working for another landscape business located in Texas for 10 years. PS. For employees in the medical industry- there are some technical things in the non-competes to become aware of. PSS. There have been some ongoing changes in this area. Call us before entering into an agreement.

MULTIPLE LAND & DEVELOPMENT DEALS - MESSAGE WITH INTEREST 1. 220 N 36th St, Temple, TX - This deal is not finished, but entitlements are in place, wastewater is to the site, water is closed, capacity is confirmed, and it is an up and coming location in Temple. The tract is 23 acres +/-, 69 mostly 50' lots... 2. 105 Wood Forest Road - This deal is 56 approved lots in Kingsland, TX with Lake LBJ access. LCRA has approved this project, and we are set for final plat approval in September with Llano County. We are going to manage the construction here and deliver finished lots, FYI. Asking price is $75,000/lot. 3. Our client that owns 220 N 36th St also owns 90 acres off IH-35 in Temple. There is about 10 acres of Flex dirt here, and the rest is residential. Plans call for some multi family components, but they are early in the process on this one and can be flexible. Pretty interesting location with this one. 4. Jarrell - our clients have been working on 850 lots in Jarrell for some time now. We have a proposed Salado Creek lotting plan as well. 5. 2451 W FM 150 - We have 21.5 acres +/- listed with the potential for up to ~56 acres in a prime spot in Kyle. This is a very interesting pocket because forever our clients were technically Mountain City ETJ so you were not going to be able to get utilities to the property. An ETJ swap between MC and Kyle recently occured, so this property is now Kyle ETJ. I think there are a lot of possibilities here, but you are looking at a great dense SF, BTR, condo/townhome site with likely some commercial component along 150. Sellers are seeking $5.5M. Great site now that it is in Kyle.  6. 7710 Elroy - We just took a 10 acre listing at COTA. This is ETJ as you know so a bunch of possible uses here... 7. 15314 W Highway 71 - Toll Brothers had it under contract about a year ago but did not do much work on it, and our client would not agree to them just perpetually extending. Where the market is currently I see it as one of the most interesting MF properties on the market in this area. TB had 185 units approved here, but there is a path to 235. We can talk pricing, and I can give you more guidance and background if there is any interest here. Seems like City of Bee Cave is pretty open to the eventual development here, too, as this property was one that saw a big change in the UDC updates of a few years ago.
