UPC Weekly from Mewburn Ellis this week – yet more cases from the UPC on preliminary injunctions. The three cases discussed are fairly hefty but here are the main points: 📣 UPC is clearly ready and willing to grant PIs. 📣 But there must be actual infringement or “imminent” infringement. Obtaining marketing authorisation and making vague announcements about intentions to launch a biosimilar is not enough. 📣 At least the UPC LD Munich takes the view that it’s impossible to take a quick look to check on validity of the patent. So they will instead only look (but look in detail) and the defendant’s best 3 invalidity attacks. 📣 UPC LD Munich reckon that there should be a safe harbour period of 2 months for the patentee to bring an application for a PI, and still be acting with the required urgency. Note that UPC LD Düsseldorf have said 1 month, so there is divergence here. 📣 Patentee will need to be prepared to pay security for damages, or argue in detail why this is not necessary. 📣 At least for classical EPs, carve-out of a national designation works to avoid a lis pendens objection.
