Stephen Putnoki-Higgins and Marc Weintraub authored an article for Tax Notes State outlining the impact of the West Virginia Private Trust Company Act, including detailing how it allows wealthy parties to establish private trust companies in West Virginia, giving them greater control over assets and investment decisions. Steve and Marc say that for clients and families who have historically made their money through closely-held or other family business enterprises, and especially for those who wish to continue to do so going forward, the West Virginia private trust company structure may be enormously liberating, and especially beneficial for families with closely-held businesses or specific investment requirements that may not align with the policies of traditional corporate trustees. A rule proposed by the FAR Council in June 2024 would (1) provide contracting incentives to mentors that subcontract to protégé firms located in Puerto Rico or other covered territories; (2) confirm that contractors may rely on a subcontractor’s self-certification; and (3) specify that subcontracting plans are not required from entities that are treated as small business concerns by the statute, such as Alaska Native Corporations (ANCs).
