X files antitrust lawsuit against major brands and ad industry group X has filed a federal antitrust lawsuit against an advertising industry coalition, including major companies like CVS Health, Mars, Orsted, and Unilever, accusing them of using their influence to discriminate against X, leading to an ad boycott unfairly. This lawsuit is part of a larger effort by conservative lawmakers and media companies to challenge the Global Alliance for Responsible Media (GARM). Filed in the U.S. District Court for the Northern District of Texas, the lawsuit claims that GARM and several unnamed collaborators conspired to withhold billions of dollars in advertising revenue from Twitter, now X Corp. X's advertising revenue has significantly declined since Elon Musk acquired the company in 2022, with expected earnings of around $2 billion this year. The lawsuit is part of X's broader strategy to address its advertising challenges through legal action. Despite adopting brand safety standards similar to its competitors, X argues that the boycott's effects persist. The 2024 election has brought the forefront a new marketing strategy, the use of strategic betting as a marketing tool shift the odds in a candidates favor and generate buzz off the betting spend. Multiple large undisclosed bets One French Financial source (CNBC) bet $28 million to shift the odds in Trump's favor on October 24th. In total, to shift all the odds across sites temporarily it would have cost approximately twice that spend so let's assume a $50 million spend. Let's analyze what $50 million dollars bought the Trump campaign: 2 weeks of global headlines claiming Trump is favored to win the election including hundreds of News media articles plus podcasts and social media coverage, A shift in the odds of victory in most election models, and a shift in public perception of a Trump victory. The value proposition of shifting odds by making targeted bets is hard to ignore and barring any regulation will probably be incorporated into future gorilla marketing strategies across multiple industries. As an example of how the betting odds have diverged from the underlying reality of the moment, the early voting returns in Pennsylvania show a high probability of Harris winning Pennsylvania while the betting odds still favor Trump. We will see how the vote turns out in 3 days but as of the latest update in Pennsylvania, the total early ballots are 56.5% Democrats to 32.6% Republicans and 10.9% Independents. This implies a Harris lead of 30%+ in the current vote tally which implies a high probability of Harris winning PA while Polymarket implies a Trump PA win at 56%. It is expected the Democrats and Republicans vote their respective parties and the independents lean to the Democrats due to their demographics. 1/3 of all PA expected votes have been cast so it is very difficult to justify the Polymarket odds based on current voter returns.
