New York Times Co. Battles OpenAI's Request for Reporters’ Source Materials in Copyright Dispute In a high-stakes legal battle, The New York Times Co. is urging a federal judge to reject OpenAI’s demand for access to reporters' notes, interview memos, and other journalistic materials. This request comes in the wake of a December 2023 copyright infringement lawsuit filed by The New York Times against OpenAI and its partner Microsoft. The lawsuit alleges that the tech companies improperly used copyrighted materials from the newspaper to train their AI models, including ChatGPT. Lawyers for both sides presented their arguments in memos submitted to the U.S. District Court for the Southern District of New York over the Fourth of July holiday week. The New York Times’ legal team argued that OpenAI's demand for comprehensive journalistic materials is unprecedented and turns copyright law on its head. They contended that OpenAI's claim—that such materials are needed to determine the protectability of The Times’ works—lacks legal basis and serves only to harass and retaliate against The Times for filing the lawsuit. OpenAI's legal representatives countered by stating that these materials are essential for determining the extent of the Times’ copyright claims and for OpenAI’s potential defenses, including fair use. They emphasized that The Times can only claim infringement on parts of the works that are original and owned or exclusively licensed to them. The New York Times responded by asserting that OpenAI has provided no case law to justify such invasive discovery. They argued that the request is far beyond what is allowed under the Federal Rules and serves no legitimate purpose. Microsoft, although named in the original lawsuit, appears not to be involved in this particular dispute over discovery. This legal battle has the potential to set significant precedents regarding the use of public materials by AI and tech companies. The New York Times alleges that Microsoft and OpenAI used a vast amount of copyrighted content from the newspaper to train their large language models. This case will likely shape the legal landscape for AI training practices and the extent to which companies can use publicly available content. Microsoft AI CEO Mustafa Suleyman recently commented on the broader issue, suggesting that content on the open web has traditionally been considered fair use, barring explicit restrictions by publishers. His remarks at the Aspen Ideas Festival highlight the evolving legal and ethical discussions surrounding AI and content usage. Beyond financial damages, The New York Times seeks an injunction to stop Microsoft and OpenAI from using their copyrighted materials and a court order for the destruction of all AI models and training sets incorporating their work.
