Companies should brace for another surge in California Invasion of Privacy Act (CIPA) claims after two federal court decisions relating to common website analytics tools. - A Central District of California decision holding that CIPA is not limited to physical devices is likely to increase CIPA claims. - A Ninth Circuit opinion undermines a common CIPA defense argument – that a user consented to data collection merely via a privacy policy or cookie policy. - The most effective way to defend against these CIPA claims is to require all users to specifically opt in to the use of ad pixels and cookies, such as through a “cookie door.” #Litigation https://lnkd.in/eenD-aRa

To Qualcomm General Counsel Ann Cathcart Chaplin, the relationship between inside and outside counsel “really matters.” Here’s her advice to outside counsel on fostering trust and long-term relationships, from someone who’s been on both sides: - Give your client time to provide feedback. They are just as busy as you! - Tell your clients what you need. No matter how much your client tries, there will always be company information they haven’t fully conveyed. - Use the lines, “Are there things you want me to know in advance?” “What’s the most efficient way for me to get the information I need?” - Seek to understand your clients’ broader business in addition to the case. Sometimes winning the case isn’t the most important thing to their ecosystem. - Understand that as much as you care, in-house lawyers will inevitably feel more responsible for a case than you. Advance preparation and communication will help with handing over control. - Ask for feedback. Finishing a project is a great excuse to ask how you can be more helpful or what you can do differently. New Ruling on Punitive Damages and Attorney Fees in California Invasion of Privacy Act (CIPA) Case As Thompson Hine has previously reported, the recent surge of privacy claims under the California Invasion of Privacy Act (CIPA) related to using website cookies, pixels, and web beacons continues to impact a several sectors. It has been especially harmful to small businesses. On July 15, Judge Rolf Treu ruled on a preliminary motion in a CIPA lawsuit and concluded that the plaintiff could potentially recover punitive damages and attorney fees. Although this case does not address the merits of whether website tracking technologies are considered pen registers or trap and trace devices under CIPA, plaintiffs may rely on it to demand larger awards and settlements in their CIPA actions. Businesses that deploy these types of online tracking technologies should immediately reassess the legal terms governing the use of their websites and whether they contain favorable dispute resolution provisions, such as remedies available for claims arising from a consumer’s use of the website. Excited to share our fifteenth post covering the state of data privacy litigation in the U.S. For updates from June, Dustin Taylor and I highlight: 1️⃣ Several rulings that decline to follow the Ninth Circuit’s Shopify decision and deny motions to dismiss for lack of personal jurisdiction. 2️⃣ How courts are deciding whether the party exception applies in session replay lawsuits and what facts are necessary to survive a motion to dismiss. 3️⃣ Three VPPA decisions that either granted, denied, or deferred motions to dismiss, showing that although new VPPA cases may have decreased, courts are still allowing these claims to proceed. 4️⃣ A VPPA class action settlement that illustrates just how costly these claims can be if they survive the pleading stage. Pryor Cashman Partner Robert deBrauwere and Associate Scott Resnick co-authored a client alert detailing the recent amendments to the California Consumer Privacy Act (CCPA) signed into law by Governor Gavin Newsom on September 28, 2024. These amendments introduce significant changes, including the inclusion of neural data as a category of sensitive personal information and the expansion of the definition of personal information to include AI systems. Businesses will need to carefully review their data practices to comply with these updates, set to become operative on January 1, 2025. I saw a recent article from Artificial Lawyer speaking to Jon Fowler on "How Will GenAI Change eDiscovery" It was a very in-depth article, covering (in part) his history with eDiscovery. One of the points mentioned that jumped out at me was the point that many lawyers expressed concerns that predictive coding would replace human judgment (where is Sarah & John Connor when you need them 😝). It also talks about how deepfake's could affect the future for eDiscovery. I felt is was a great insight into how an expert in the Legal Tech Sector sees the future of eDiscovery, The good, The Bad and The Ugly (2nd film drop).
