US...heads up!! EPA has posted LBP FINAL RULES... This document has a number of pages that make up with we call the preamble. Those that have kept up with these issues can scan it.those that have not should really read this document. These issues are no longer of debate. The only complication is the readiness of NLLAP labs for be able to meet reporting requirements, especially for floors. And then, when will state programs get on board. "EPA is finalizing its proposal to lower the dust-lead hazard standards (DLRL) to any reportable level as analyzed by a laboratory recognized by EPA's National Lead Laboratory Accreditation Program (NLLAP)" "EPA is also finalizing changes to lower the post-abatement dust-lead clearance levels (DLAL) to 5 micrograms per square foot (mcg/ft2), 40 mcg/ft2, and 100 mcg/ft2 for floors, window sills and troughs respectively." DATES: This final rule is effective January 13, 2025 See page 89447 (VI. Effective and Compliance Dates): The compliance date for these provisions is on January 12, 2026. TL note: this has much to do with labs getting prepared to meet LQSR reporting requirements. TL note: your state may require the new DLRL/DLAL prior to Jan 12, 2026. Even if your state does not have the political capital to change state regs by 12/12/2026, to not implement the new values for risk assessment/dust clearance may put your client at risk for federal enforcement of violations. ALSO: EPA is finalizing regulatory changes to adjust the age requirements from 6 years of age and under, to under age 6 for the definition of target housing. TL note: this has been a problem in the EPA regs. RRP and risk assessment were under 6. Lead-based paint activities as those found in 745.227 were 6 and under. If your state defines a COF as 6 and under, seems that could remain. Designated programs can be more stringent than federal rules. HUD LSHR has been under 6 for years. ALSO: 6. Definition of Housing for the Elderly EPA is finalizing the proposed addition of the definition of ''housing for the elderly'' to 40 CFR  745.223 in order to clarify the term ''elderly'' used in the definition of ''target housing,'' also in 40 CFR 745.223. EPA already defines ''housing for the elderly'' in 40 CFR 745.103 as ''retirement communities or similar types of housing reserved for households composed of one or more persons 62 years of age or more at the time of initial occupancy'' ALSO: for HUD programs and applicability, see page 89443, center column ALSO HUD has informed the Agency that it will likely revise Chapter 5 of the Guidelines on risk assessment and reevaluation, Chapter 12 on abatement, and Chapter 15 on clearance, and make conforming changes elsewhere as needed. It's up to you to read the document if you need more info. This should get you started.

Renewable fuel momentum continues! The #EPA reported 2.03 billion #RINs generated under the #RenewableFuelStandard in November, with nearly 89 million #D3 RINs for advanced cellulosic biofuels like #RNG. Total RINs for 2024 are trending higher than 2023, reflecting growing contributions from #renewableenergy solutions. #RenewableFuels #renewablenaturalgas #wastetoenergy #sustainability

In the future, Daviess County Landfill gas will be used for energy generation. Construction is nearly complete on a new Point of Receipt (POR) meter station that will connect to the ANR Pipeline System, now part of TC Energy. Travis Ricker is the Solid Waste Manager for the Landfill. He expects the facility will be operational early next year. Crews are building a new 6-inch pipeline lateral to connect the meter station with the existing ANR 501 Pipeline, a distance of roughly five miles. The lateral pipeline will have dual taps capable of delivering up to 1.4 million standard cubic feet per day of natural gas. #DaviessCounty #Owensboro #SolidWaste #Landfill

SBA Grant for Small Manufacturers to upgrade their facilities: (Pulled from the website): Eligible applicants include small- to medium-sized manufacturers with: Gross annual sales of less than $100M; Annual energy bills between $100,000 - $3,500,000; and Fewer than 500 employees at the plant site. The IAC Implementation Grants Program provides grants of up to $300,000 per project at a 50% cost share. For example, if a project costs $100,000, an implementation grant can cover up to $50,000. I'm breaking out my soapbox again. No matter how you feel about the current type of systems that you are offering your customers right now, there is a very simple way to give your customer peace of mind, knowing that their system will adapt to ever changing energy costs in the future. When making a product offering choice, look hard at the new inverter heat pumps. Almost every one can simply be installed as a very highly efficient air conditioner. Match that with any heating source you desire. The only item that will be required differently from a normal split system furnace/Ac is installing a bi-flow filter drier instead of a one way. This will give the homeowner the option to convert to a duel fuel heat pump application with the flip of a switch. All while saving energy in the summer with a high SEER2 air conditioner. It's really a no-brainer that could differentiate you from others at the kitchen table.

At a time when the Federal Energy Regulatory Commission, grid operators (including PJM Interconnection, Midcontinent Independent System Operator (MISO), ISO New England Inc., and Southwest Power Pool), and North American Electric Reliability Corporation (NERC) are all saying we already have a reliability problem, these proposed rules make it more difficult to ensure adequate amounts of generation can be retained and added to the system to ensure reliability. Further, the layering on of significant load growth for the first time in a generation that will require all the MW we have and more (aka energy expansion) is real; we are walking headlong into an otherwise avoidable reliability crisis. We at Electric Power Supply Association continue to support efforts to reduce emissions and believe market-based approaches are the best, most efficient, and cost-effective way to deliver that outcome. But arbitrary compliance timelines and amounts of reductions without consideration of the operational impacts and in the face of blaring warnings will raise costs for consumers and threaten reliability - and that's unacceptable for energy users of all kinds. #reliability #power #emissions #energy

Why do the regulations/requirements for direct potable reuse look so different from one state to another? Shouldn’t public health protection be the same regardless of where you are? The current issue of the Potable Water Reuse Report dives into this question and sheds light on several elements OUTSIDE of the public health sphere that often drive these requirements. Limiting PFAS exposure in WA States drinking water is a positive step, but it's only part of the solution.
